Please read these Beta Programme at PlayStation Terms (“Programme Terms”) carefully before agreeing to participate in the Beta Programme at PlayStation (“Programme”). The Programme is provided by Sony Interactive Entertainment LLC and its affiliates (”SIE”, “we”, or “us”). By choosing [Agree] you are agreeing to participate in this Programme subject to these Programme Terms along with the PlayStation Terms of Service ("TOS"). These Programme Terms supplement the TOS. This means we will rely on these Programme Terms and the TOS to govern your participation in the Programme.  When we refer to "Terms" in this document, we mean both these Programme Terms and the TOS.  In the event of any conflict between the Programme Terms and the TOS, the Programme Terms apply to the extent of any inconsistency.

AS A CONSUMER YOU MAY HAVE RIGHTS UNDER APPLICABLE LOCAL LAWS THAT CANNOT BE EXCLUDED, LIMITED OR CHANGED. THOSE RIGHTS TAKE PRIORITY OVER ANYTHING IN THESE TERMS.

1.       Your Participation

a.       Eligibility. To sign up and participate in the Programme you must: 1) be at least 18 years old and have reached the legal age of majority in the country/region in which your account for PlayStation (“Account”) is registered; 2) have an account in good standing; 3) reside in a country/region in which the Programme is available; and 4) agree to and comply with these Programme Terms.

b.      Beta Product(s). We may provide you with opportunities to access various pre-release beta software (including any related content and documentation) to help test and gather feedback on new products, features and services before they are released to the general public, including  new unreleased games and pre-release PlayStation device software like console software updates,(each such beta software is herein referred to as a “Beta Product”).  You must keep the Beta Product in your control at all times and take reasonable efforts to prevent others from using it.  You are responsible for any loss or damage to the Beta Product including any loss or damage to any intellectual property rights held therein by SIE or any other third party rightsholder.  You will immediately notify SIE if you become aware that any Beta Product provided to you under this Programme is distributed or transferred to any unauthorised third party.

c.       Availability and Updates. Beta Products may be made available for both PlayStation and non-PlayStation devices (e.g. PlayStation consoles, PC or mobile devices). If the Beta Product is for a non-PlayStation device your access and use of the Beta Product may require you to accept separate and additional terms and conditions that govern your use of that third party device and/or platform.   The Beta Product, including any downloadable content or online services, may be modified or terminated at any time for any reason, including by automatic update or otherwise.

d.      Beta Community Forums. You may be provided access to official communication channels, such as private community servers or in-game communications, in connection with your use of the Beta Product (“Beta Community Forums”). These Beta Community Forums may be provided and operated by us, or by a third-party service provider. Any such third-party service provider may require you to accept separate and additional terms and conditions that govern your use of that third party service. Additionally, any passwords for the Beta Community Forums must be unique from any other of your online account passwords and you must use multi-factor authentication where offered by the Beta Community Forum.

e.       Digital Content Limitations. Digital content for the Beta Product, such as virtual currency or items usable in the Beta Product or progression/unlocks, that you receive or gain access to as part of your participation in the Programme will not be retained or made available to you as part of any general release version of the Beta Product.

f.        Limited Licence. When you install a Beta Product, the owner and rightsholder in the Beta Product (“Licensor”) grants to you a limited, revocable, non-exclusive licence to use the Beta Product for the sole purpose of testing the Beta Product on your device for which the Beta Product was designed.  Licensor reserves all rights in the Beta Product not explicitly granted to you in this licence, including rights to all intellectual property contained in the Beta Product.  This licence does not include the right to, and you agree not to (a) rent, lease, or sublicense the Beta Product or make it available on a network to other users; (b) modify, adapt, translate, reverse engineer, decompile, or disassemble the Beta Product; (c) create derivative works from the Beta Product; or (d) copy, publicly perform, or broadcast the Beta Product in an unauthorised manner.

g.       Contacts. As part of the Programme, you agree SIE and/or Licensor may contact you through various means including email, surveys, PlayStation notifications, and Beta Community Forums to enable and support your participation in the Programme and use of any Beta Product, including to inform you about Programme news and changes, Beta Product testing opportunities, and learn more about your experiences using the Beta Product.

h.      Feedback. We welcome and encourage your ideas and feedback on the Beta Products and Programme (“Feedback”), but you must only provide your own Feedback. By providing Feedback you transfer ownership of it to us, and such Feedback can be used by us in any way and for any purpose without charge.

i.         Additional Terms for certain Beta Products. In addition to these Terms, when accessing and installing some Beta Products you may also be required to accept additional and separate terms and conditions that govern your use of that specific Beta Product (“Additional Terms”).  

j.        Programme Violations. If you breach the Programme Terms or violate any Programme rules or guidelines we may take various immediate actions, with or without notice to you, including revoking your access to the Programme and any Beta Products. A violation of these Programme Terms could also result in a suspension or termination of your Account in accordance with the TOS.

2.       Confidential and Pre-release Nature of the Beta Product.

a.       The Beta Product and any information or data regarding your use of the Beta Product (e.g., Beta Community Forums and communications through them, keys or passwords allowing access to the Beta Product, or email communications and surveys), is SIE and/or Licensor’s confidential information.  You may use the Beta Product only in your home or another location expressly authorised in writing by SIE solely for the purpose of testing the Beta Product, and, except as permitted through Beta Community Forums or as otherwise expressly authorised in writing by SIE, you will not transfer, distribute or disclose any materials or any information in connection with the Beta Product to any third party, including through a public exhibition or display, nor discuss your experience with the Beta Product with third parties or publish or disseminate information about those experiences.

b.      The Beta Product consists of pre-release software and materials that are not intended for public release, have not been thoroughly tested, and may be incomplete and contain errors. The Beta Product may cause your device to experience system errors, feature or function loss, corruption or loss of data or content, and could similarly cause errors with peripherals or other connected devices.

c.       Disclosure of any part of the Beta Product or your experiences using the Beta Product to any third party except as permitted by these Programme Terms, including any trade or consumer press, news agency, or any competitor of SIE and/or Licensor, will cause significant and irreparable harm to SIE and/or Licensor, the extent of which may be difficult to ascertain.  Accordingly, SIE and/or Licensor is entitled to injunctive relief as well as all other legal remedies that may be available if you breach these Programme Terms.

d.      Neither SIE or Licensor has promised or guaranteed to you that any Beta Product made available to you under this Programme, will be released to the general public or otherwise made generally available in the future.

e.       Under no circumstances may you share or allow anyone else to use any token, key, password, or other device given to you that permits your personal access to the Beta Product or Beta Community Forums.

3.       Privacy and Data Protection. By accepting these Programme Terms, participating in the Programme and/or using a Beta Product, you acknowledge that SIE may collect information about you, your participation in the Programme, and your use of a Beta Product irrespective of your device data collection settings.For more information about our privacy practises, including what Personal Information (“PI”) we collect, why we collect it, how we use it, who we share it with, where it is processed, how we handle it and your choices and legal rights associated with this information, please visit   https://www.playstation.com/legal/privacy-policy/.

4.       Miscellaneous

a.       Changes to the Terms. You are bound by the most current version of these Programme Terms.  SIE may modify the Terms at any time.  Your continued participation in the Programme and/or access to or use of any Beta Product will signify your acceptance of the latest version of the Terms.

b.      Disputes and Enforcement of Terms. These Programme Terms, any contracts formed in accordance with them, and any disputes we may have in connection with them will be governed by and determined in accordance with those provisions of the TOS applicable to dispute resolution, including governing law, venue, jurisdiction, and any arbitration provisions. For the avoidance of doubt, unless there are Additional Terms that expressly state otherwise, the SIE contracting entity providing the Beta Product to you is based on the TOS and your region of residence as follows:

Baca Ketentuan Beta Program at PlayStation (“Ketentuan Program”) ini dengan saksama sebelum menyetujui untuk berpartisipasi dalam Beta Program at PlayStation (“Program”). Program ini diprakarsai oleh Sony Interactive Entertainment LLC dan afiliasinya (“SIE” atau “kami”). Dengan memilih [Setuju], artinya Anda menyetujui untuk berpartisipasi dalam Program ini dengan mematuhi Ketentuan Program ini serta Ketentuan Layanan dan Perjanjian Pengguna PlayStation Network/PlayStation Network Terms of Service and User Agreement ("PSN TOSUA"). Ketentuan Program ini berfungsi sebagai tambahan untuk ketentuan dalam PSN TOSUA. Artinya, partisipasi Anda dalam Program akan diatur berdasarkan Ketentuan Program ini dan PSN TOSUA. Kata "Ketentuan" dalam dokumen ini berarti Ketentuan Program ini dan PSN TOSUA. Jika terdapat perbedaan antara Ketentuan Program dan PSN TOSUA, ketentuan yang akan berlaku untuk bagian yang tidak konsisten tersebut adalah Ketentuan Program.

SEBAGAI KONSUMEN, BERDASARKAN KETENTUAN HUKUM SETEMPAT YANG BERLAKU, ANDA DAPAT MEMILIKI HAK YANG TIDAK DAPAT DIKECUALIKAN, DIBATASI, ATAU DIUBAH. HAK TERSEBUT LEBIH DIUTAMAKAN DIBANDINGKAN DENGAN PERNYATAAN APA PUN DALAM KETENTUAN INI.

1.       Partisipasi

a.       Persyaratan Partisipasi. Untuk mendaftarkan diri dan berpartisipasi dalam Program ini, Anda harus memenuhi syarat berikut: 1) berusia minimal 18 tahun dan telah mencapai usia dewasa menurut hukum di negara/wilayah tempat akun PlayStation Network (“Akun PSN”) Anda terdaftar; 2) memiliki akun PSN dengan reputasi baik; 3) berdomisili di negara/wilayah tempat Program ini tersedia; dan 4) menyetujui serta mematuhi Ketentuan Program ini.

b.      Produk Beta. Kami dapat memberi Anda kesempatan untuk mengakses berbagai perangkat lunak beta versi praperilisan (termasuk konten dan dokumen terkait) untuk membantu pengujian dan mengumpulkan umpan balik tentang produk, fitur, serta layanan baru sebelum dirilis untuk umum, termasuk game baru yang belum dirilis dan perangkat lunak perangkat PlayStation praperilisan, misalnya pembaruan perangkat lunak konsol (setiap perangkat lunak beta tersebut selanjutnya disebut “Produk Beta” dalam dokumen ini). Anda harus memastikan Produk Beta selalu dalam kendali Anda dan melakukan upaya yang wajar untuk mencegah orang lain menggunakannya. Anda bertanggung jawab atas kehilangan atau kerugian apa pun pada Produk Beta, termasuk kehilangan atau kerugian terkait hak kekayaan intelektual apa pun yang dimiliki oleh SIE atau pemegang hak pihak ketiga lainnya dalam Produk Beta tersebut. Anda harus segera memberi tahu SIE jika mengetahui bahwa Produk Beta yang diberikan kepada Anda berdasarkan Program ini disebarluaskan atau dipindahtangankan kepada pihak ketiga yang tidak berwenang.

c.       Ketersediaan dan Pembaruan. Produk Beta dapat tersedia untuk perangkat PlayStation dan non-PlayStation (misalnya konsol PlayStation, PC, atau perangkat seluler). Jika Produk Beta ditujukan untuk perangkat non-PlayStation, akses dan penggunaan Produk Beta oleh Anda dapat mengharuskan Anda untuk menyetujui syarat dan ketentuan terpisah dan tambahan yang mengatur penggunaan Anda atas perangkat dan/atau platform pihak ketiga tersebut. Produk Beta, termasuk konten atau layanan online yang dapat diunduh, dapat dimodifikasi atau dihentikan kapan saja karena alasan apa pun, termasuk pembaruan otomatis atau alasan lainnya.

d.      Forum Komunitas Beta. Anda dapat diberi akses ke berbagai saluran komunikasi resmi, seperti server komunitas privat atau komunikasi dalam game, sehubungan dengan penggunaan Anda atas Produk Beta (“Forum Komunitas Beta”). Forum Komunitas Beta ini dapat disediakan dan dioperasikan oleh kami sendiri atau penyedia layanan pihak ketiga. Penyedia layanan pihak ketiga tersebut dapat mengharuskan Anda untuk menyetujui syarat dan ketentuan terpisah dan tambahan yang mengatur penggunaan Anda atas layanan pihak ketiga tersebut. Selain itu, kata sandi untuk Forum Komunitas Beta harus berbeda dari kata sandi akun online lain milik Anda. Anda juga harus menggunakan autentikasi multifaktor jika fitur ini ditawarkan oleh Forum Komunitas Beta.

e.       Batasan Konten Digital. Konten digital untuk Produk Beta, seperti mata uang atau item virtual yang dapat digunakan di Produk Beta atau progres/buka kunci, yang Anda terima atau dapatkan aksesnya sebagai bagian dari partisipasi Anda dalam Program tidak akan disimpan atau disediakan kepada Anda ketika Anda mengakses Produk Beta dalam versi yang dirilis untuk umum.

f.        Lisensi Terbatas. Saat Anda menginstal suatu Produk Beta, pemilik dan pemegang hak pada Produk Beta tersebut (“Pemberi Lisensi”) memberi Anda lisensi terbatas yang dapat dibatalkan dan noneksklusif untuk menggunakan Produk Beta dengan tujuan tunggal, yaitu menguji Produk Beta di perangkat Anda yang dirancang untuk penggunaan Produk Beta tersebut. Pemberi Lisensi memiliki semua hak pada Produk Beta yang tidak secara tegas diberikan kepada Anda dalam lisensi ini, termasuk hak atas semua kekayaan intelektual yang terdapat dalam Produk Beta. Lisensi ini tidak mencakup hak untuk, dan Anda setuju untuk tidak, (a) menyewakan, menyewagunakan, atau mensublisensikan Produk Beta atau membuatnya tersedia di suatu jaringan untuk pengguna lain; (b) memodifikasi, mengadaptasi, menerjemahkan, merekayasa balik, mendekompilasi, atau membongkar Produk Beta; (c) membuat karya turunan dari Produk Beta; atau (d) menyalin, menjalankan secara publik, atau menyiarkan Produk Beta secara tidak sah.

g.       Kontak. Sebagai bagian dari Program, Anda setuju bahwa SIE dan/atau Pemberi Lisensi dapat menghubungi Anda melalui berbagai sarana, termasuk email, survei, notifikasi PlayStation, dan Forum Komunitas Beta untuk memungkinkan dan mendukung partisipasi Anda dalam Program dan penggunaan Anda atas Produk Beta, termasuk untuk menyampaikan berita dan perubahan Program atau kesempatan menguji Produk Beta kepada Anda, serta untuk mempelajari lebih lanjut pengalaman Anda dalam menggunakan Produk Beta.

h.      Umpan Balik. Kami menyambut dan mendukung penyampaian ide serta umpan balik Anda terkait Produk dan Program Beta (“Umpan Balik”). Namun, Anda hanya boleh memberikan Umpan Balik Anda sendiri. Dengan memberikan Umpan Balik, artinya Anda mengalihkan kepemilikan atas Umpan Balik tersebut kepada kami, dan Umpan Balik tersebut dapat digunakan oleh kami dengan cara apa pun dan untuk tujuan apa pun tanpa biaya.

i.         Ketentuan Tambahan untuk Produk Beta Tertentu. Selain Ketentuan ini, ketika mengakses dan menginstal Produk Beta tertentu, Anda juga dapat diharuskan untuk menyetujui syarat dan ketentuan tambahan dan terpisah yang mengatur penggunaan Anda atas Produk Beta tertentu tersebut (“Ketentuan Tambahan”).

j.        Pelanggaran Program. Jika Anda melanggar Ketentuan Program atau melanggar aturan atau pedoman Program, kami dapat segera mengambil tindakan, dengan atau tanpa pemberitahuan kepada Anda, termasuk membatalkan akses Anda ke Program dan Produk Beta. Jika Anda melanggar Ketentuan Program ini, akun PSN Anda juga dapat ditangguhkan atau dinonaktifkan sesuai dengan ketentuan PSN TOSUA.

2.       Kerahasiaan dan Praperilisan Produk Beta.

a.       Produk Beta dan segala informasi atau data terkait penggunaan Produk Beta oleh Anda (misalnya Forum Komunitas Beta dan komunikasi melalui forum tersebut, kunci atau kata sandi yang memungkinkan akses ke Produk Beta, atau komunikasi dan survei melalui email) merupakan informasi rahasia milik SIE dan/atau Pemberi Lisensi. Anda hanya boleh menggunakan Produk Beta di rumah Anda dengan tujuan semata-mata untuk menguji Produk Beta, dan, kecuali sebagaimana diizinkan melalui Forum Komunitas Beta, Anda tidak akan mentransfer, mendistribusikan, atau mengungkapkan materi atau informasi apa pun sehubungan dengan Produk Beta kepada pihak ketiga mana pun, termasuk melalui pameran atau pertunjukan publik, atau membahas pengalaman Anda dalam menggunakan Produk Beta kepada pihak ketiga atau menerbitkan atau menyebarluaskan informasi tentang pengalaman tersebut.

b.      Produk Beta terdiri dari perangkat lunak dan materi praperilisan yang tidak ditujukan untuk umum, belum diuji secara menyeluruh, dan mungkin tidak lengkap serta berisi kesalahan. Produk Beta dapat menyebabkan perangkat Anda mengalami kesalahan sistem, kehilangan fitur atau fungsi, kerusakan atau kehilangan data atau konten, dan dapat mengakibatkan kesalahan pada periferal atau perangkat terhubung lainnya.

c.       Pengungkapan bagian mana pun dari Produk Beta atau pengalaman Anda dalam menggunakan Produk Beta kepada pihak ketiga mana pun, kecuali sebagaimana diizinkan melalui Forum Komunitas Beta, termasuk pers perdagangan atau konsumen, kantor berita, atau pesaing SIE dan/atau Pemberi Lisensi, akan menimbulkan kerugian yang signifikan dan tidak dapat diperbaiki bagi SIE dan/atau Pemberi Lisensi, yang besarnya mungkin sulit untuk dipastikan. Oleh karena itu, SIE dan/atau Pemberi Lisensi berhak memperoleh penyelesaian berdasarkan perintah pengadilan sementara serta menempuh semua upaya hukum lainnya yang mungkin tersedia jika Anda melanggar Ketentuan Program ini.

d.      SIE dan Pemberi Lisensi tidak menjanjikan atau menjamin kepada Anda bahwa setiap Produk Beta yang disediakan kepada Anda berdasarkan Program ini akan dirilis untuk umum atau disediakan secara umum pada masa mendatang.

e.       Dalam kondisi apa pun, Anda tidak diperbolehkan untuk membagikan atau memperbolehkan orang lain untuk menggunakan token, kunci, kata sandi, atau perangkat lain yang diberikan kepada Anda yang mengizinkan akses pribadi Anda ke Produk Beta atau Forum Komunitas Beta.

3.       Privasi dan Perlindungan Data. Dengan menyetujui Ketentuan Program ini, berpartisipasi dalam Program, dan/atau menggunakan Produk Beta, Anda memahami bahwa SIE dapat mengumpulkan informasi tentang Anda sesuai dengan Kebijakan Privasi kami.Untuk informasi selengkapnya tentang praktik privasi kami, termasuk Informasi Pribadi (“IP”) yang kami kumpulkan, alasan pengumpulannya, cara penggunaannya, pihak yang menerimanya, cara pemrosesannya, cara penanganannya, serta pilihan dan hak yang Anda miliki berdasarkan hukum terkait informasi ini, kunjungi https://www.playstation.com/legal/privacy-policy/.

4.       Lain-Lain

a.       Perubahan Ketentuan. Anda terikat oleh Ketentuan Program versi terkini. SIE dapat sewaktu-waktu mengubah Ketentuan. Jika tetap melanjutkan partisipasi Anda dalam Program dan/atau akses ke atau penggunaan Produk Beta apa pun, artinya Anda menyetujui versi terbaru Ketentuan.

b.      Perselisihan dan Penegakan Ketentuan. Ketentuan Program, kontrak yang dibuat berdasarkan Ketentuan Program ini, dan perselisihan yang dapat timbul sehubungan dengannya akan diatur dan diselesaikan sesuai dengan ketentuan PSN TOSUA yang berlaku untuk penyelesaian perselisihan, termasuk hukum yang mengatur, lokasi, yurisdiksi, dan ketentuan arbitrase. Untuk menghindari keraguan, kecuali jika terdapat Ketentuan Tambahan yang secara tegas menyatakan lain, entitas kontrak SIE yang menyediakan Produk Beta kepada Anda didasarkan pada PSN TOSUA dan wilayah domisili Anda sebagai berikut:
