Specific Rules for “UEFA Champions League Fans’ Final” Competition

Terms and Conditions

 

1.             The “UEFA Champions League Fans’ Final” competition (“Competition”) is open to persons aged 18 years or over who are residents of Austria, Belgium, the Czech Republic, Denmark, Finland, France, Germany, Hungary, Ireland, the Netherlands, Norway, Poland, Portugal, Russia, Slovakia, Spain, Sweden, Switzerland and the United Kingdom (“Entrant Countries / Country”) except employees, agents, contractors or consultants of the Promoter (as defined below) and their immediate families, the Promoter's associated companies and anyone else professionally connected with the Competition (“Entrants). These Terms (as defined below) apply to those Entrants resident of Austria, Belgium, the Czech Republic, Denmark, Finland, Germany, Hungary, Ireland, the Netherlands, Norway, Poland, Portugal, Russia, Slovakia, Spain, Sweden, Switzerland and the United Kingdom.

 

2.             The Competition is open for entries on 14 April 2015 at 09.00 (GMT) ("Opening Date") and closes on 04 May 2015 at 23.59 (GMT) ("Closing Date").  The period from the Opening Date to and including the Closing Date shall be referred to as the “Competition Period.

 

3.             The Competition is free to enter and no purchase of any kind is necessary. By entering the Competition, Entrants accept and will be bound by these terms and conditions (“Terms”) as well as the General Rules (click here).

 

4.             To enter the Competition, Entrants must complete the following steps during the Competition Period:

a)     if they do not already have a Sony Entertainment Network (“SEN”) account (previously known as PlayStation®Network account), create one using their PlayStation® system or by visiting http://eu.playstation.com/registration/;

b)    visit the PlayStation® competitions website at eu.playstation.com/psn/competitions;

c)     click on the “UEFA Champions League Fans’ Final” Competition link;

d)    enter their email address in the field provided;

e)     click “Start” to begin;

f)     examine the image showing Pro Evolution Soccer™ football game play with the football removed;

g)    follow the instructions to select what they think is the correct location of the missing football;

h)     enter an answer to the “tie-breaker” question (“Tie-breaker”) and click “Submit”;

i)      enter the information in the fields provided; and

j)      enter the unique CAPTCHA code that will be visible and click “Submit”.

                            

5.             Registration for SEN is subject to acceptance of the SEN Terms of Service and User Agreement and SEN Privacy Policy. (http://uk.playstation.com/legal/).

 

6.             Each Entrant may only submit one (1) entry and will only be eligible to win one (1) Prize (as defined below).

 

7.             There will be one (1) winner (“Winner”), one (1) first runner-up (“First Runner-Up”), three (3) second runners-up (each a “Second Runner-Up”) and five (5) third runners-up (each a “Third Runner-Up”). The Winner, the First Runner-Up, each Second Runner-Up and each Third Runner-Up will be determined as follows:

 

a)     the Winner shall be the Entrant who has selected the correct location of the football.  In the event of a tie, the Winner shall be the Entrant that selected the correct location of the football and that provided the correct answer to the Tie-breaker;

b)    if, instead of a tie, insufficient Entrants provided the correct answer to the Tie-breaker to allow Winner selection, the Winner shall be the Entrant whose answer to the Tie breaker is closest to the correct answer;

c)     in the event of any further tie, those Entrants shall answer another “tie-breaker” question to determine the Winner, in accordance with the ranking mechanism set out in a) and b) above.  In the event of a further tie, this process shall be repeated until the Winner is obtained;

d)    the First Runner-Up will be the Entrant with the highest Score after the Winner and shall be determined using the mechanism set out in a), b) and c) above;

e)     the Second Runner-Ups will be the Entrants with the three (3) highest Scores after the First Runner-Up and shall be determined using the mechanism set out in a), b) and c) above; and

f)     the Third Runner-Ups will be the Entrants with the five (5) highest Scores after the Second Runner-Ups and shall be determined using the mechanism set out in a), b) and c) above.

 

8.             The Promoter shall notify the Winner, by email to the email address linked their SEN account, of their selection within one (1) week of the Closing Date.

 

9.             In order to claim their Winner Prize (as defined below), the Winner must respond appropriately to the Promoter’s notification email within three (3) days from the date of the Promoter’s notification email, and provide their full name, postal address, date of birth, contact phone number and the name of their chosen companion (who must also be over eighteen (18) years of age) (“Companion”). The postal address provided must match any postal address provided at the time of entry, or the Winner may be disqualified.

 

10.           The Winner will win the following “Winner Prize”:

g)    two (2) tickets (one (1) ticket for the Winner and one (1) ticket for their Companion) to the Legendary Moments Fan Match (including the UEFA Champions League Final) to be held at the Olympiastadion in Berlin, Germany from 06 June 2015 to 07 June 2015 inclusive (“Winner Event”);

h)     return economy class flights for the Winner and their Companion from the Winner’s home country to Berlin Schönefeld Airport, Germany, outbound on 05 June 2015 and inbound on 07 June 2015 (flights may not be direct);

i)        two (2) nights’ stay in a double or twin room at a hotel in Berlin with a minimum three (3) star rating (“Hotel”), including breakfast;

j)        return transport from Berlin Schönefeld Airport to the Hotel on the dates of their inbound and outbound flights;

k)      return transport from the Hotel to the Event on 06 June 2015 and 07 June 2015;

l)        EUR 400 (or the Winner's local currency equivalent, to be determined on the day the money is sent to the Winner) of spending money to be put towards meals, drinks, tips and transport (other than transport expressly included above) for the duration of the trip (“Spending Money”);

m)   one (1) PlayStation®4 system (Jet Black, 500GB);

n)     one (1) Wireless Stereo Headset 2.0; and

o)    one (1) PES 2015: Pro Evolution Soccer PlayStation®4 Disc Game.

 

11.          The ultimate value of the Winner Prize will vary according to the transport and accommodation provided, however the approximate Prize value (excluding VAT) is:

a)     1500 GBP; and

b)    EUR 2000 / CZK 56025 / DKK 15240 / HUF 616650 / NOK 17580 / PLN 8400 / RUB 129480 / SEK 18990 / CHF 2145.

 

12.          The Winner will be contacted by a third party agency (“Agency”) within one (1) week of the date on which they confirmed their details to the Promoter, to arrange travel and other prize logistics. The Agency may liaise with the Winner to discuss suitable travel arrangements (for example, preferred departure airports and flight times), however all flight, hotel and transport arrangements are at the Agency and the Promoter’s sole discretion.

 

13.          The Winner and their Companion will be required to complete and return an information and prize acceptance form and submit copies of their passports to the Agency to enable the Agency to make the required arrangements.  At the Agency’s request, the Winner shall provide any further personal details (for themselves and their Companion) which the Agency may reasonably require.

 

14.          The Winner is responsible for all travel and other related expenses not forming part of the Winner Prize, including but not limited to transport to and from the Winner’s home to the airport, travel insurance, and any meals or other refreshments in excess of the Spending Money.

 

15.          The Winner will need to provide valid credit or debit card details to the Hotel at check-in as a security deposit.

 

16.          The Winner and their Companion must have a valid passport with an expiry date of at least six (6) months after the date of the return flight.

 

17.          Travel visas are the responsibility of the Winner and their Companion. The Winner and their Companion may be required to visit the relevant website and complete the required information to apply for authorisation to enter Germany.  The Winner and their Companion may not gain entry to Germany without a valid visa (if applicable).

 

18.          The Winner and their Companion must each bring a copy of their government issued photo ID, such as a passport, or driver's license, to gain entry to the Event.

 

19.          The Promoter will use reasonable endeavours to send the Winner Prize to the Winner as follows:

a)     by email, to the email address provided by the Winner, electronic tickets or booking confirmations for the flights, Event, transport, and Hotel (“Documents”). The Winner is responsible for printing any of the abovementioned Documents;

b)    by bank transfer, to a bank account specified by the Winner, or by cheque sent via registered post, to the postal address provided by the Winner, the Spending Money; and

c)     by registered post, to the postal address provided by the Winner, the remaining components of the Winner Prize other than those set out in a), b) and c) above

within four (4) weeks of the point at which any further details have been provided to the Promoter and/or Agency by the Winner as required.

 

20.          The Promoter shall notify the First Runner-Up, by email to the email address linked their SEN account, of their selection within one (1) week of the Closing Date.

 

21.          In order to claim their First Runner-Up Prize (as defined below), the First Runner-Up must respond appropriately to the Promoter’s notification email within three (3) days from the date of the Promoter’s notification email, and provide their full name, postal address, date of birth, contact phone number and the name of their chosen Companion. The postal address provided must match any postal address provided at the time of entry, or the First Runner-Up may be disqualified.

 

22.           The First Runner-Up will win the following “First Runner-Up Prize”:

a)     two (2) tickets (one (1) ticket for the First Runner-Up and one (1) ticket for their Companion) to the UEFA Champions League Final to be held at the Olympiastadion in Berlin, Germany on 06 June 2015 (“First Runner-Up Event”);

b)    return economy class flights for the First Runner-Up and their Companion from the First Runner-Up’s home country to Berlin Schönefeld Airport, Germany, outbound on 05 June 2015 and inbound on 07 June 2015 (flights may not be direct);

c)      two (2) nights’ stay in a double or twin room at the Hotel, including breakfast;

d)      return transport from Berlin Schönefeld Airport to the Hotel on the dates of their inbound and outbound flights;

e)      return transport from the Hotel to the Event on 06 June 2015;

f)       Spending Money;

g)    one (1) PlayStation®4 system (Jet Black, 500GB);

h)     one (1) Wireless Stereo Headset 2.0; and

i)      one (1) PES 2015: Pro Evolution Soccer PlayStation®4 Disc Game.

 

23.          The ultimate value of the First Runner-Up Prize will vary according to the transport and accommodation provided, however the approximate First Runner-Up Prize value (excluding VAT) is:

a)     1000 GBP; and

b)    EUR 1360 / CZK 37350 / DKK 10160 / HUF 411100 / NOK 11720 / PLN 5600 / RUB 86320 / SEK 12660 / CHF 1430.

 

24.          The First Runner-Up will be contacted by the Agency within one (1) week of the date on which they confirmed their details to the Promoter, to arrange travel and other prize logistics. The Agency may liaise with the First Runner-Up to discuss suitable travel arrangements (for example, preferred departure airports and flight times), however all flight, hotel and transport arrangements are at the Agency and the Promoter’s sole discretion.

 

25.          The First Runner-Up and their Companion will be required to complete and return an information and prize acceptance form and submit copies of their passports to the Agency to enable the Agency to make the required arrangements.  At the Agency’s request, the First Runner-Up shall provide any further personal details (for themselves and their Companion) which the Agency may reasonably require.

a)     by email, to the email address provided by the First Runner-Up, the Documents. The First Runner-Up is responsible for printing any of the abovementioned Documents;

b)    by bank transfer, to a bank account specified by the First Runner-Up, or by cheque sent via registered post, to the postal address provided by the First Runner-Up, the Spending Money; and

c)     by registered post, to the postal address provided by the First Runner-Up, the remaining components of the First Runner-Up Prize other than those set out in a), b) and c) above

within four (4) weeks of the point at which any further details have been provided to the Promoter and/or Agency by the First Runner-Up as required.

 

32.          The Promoter shall notify each Second Runner-Up and each Third Runner-Up, by email to the email address linked to their SEN account, of their selection within four (4) weeks of the Closing Date.

 

33.          In order to claim their Prize (as defined below), each Second Runner-Up and each Third Runner-Up must respond appropriately to the Promoter’s notification email within one (1) week from the date of the Promoter’s notification email, and provide their full name, postal address and date of birth. The postal address provided must match any postal address provided at the time of entry, or the Entrant may be disqualified.

 

34.          Each Second Runner-Up will win:

a)     one (1) PlayStation®4 system (Jet Black, 500GB);

b)    one (1) Wireless Stereo Headset 2.0; and

c)     one (1) PES 2015: Pro Evolution Soccer PlayStation®4 Disc Game

with a total approximate value of EUR 680 / CZK 18675 / DKK 5080 / HUF 205550 / NOK 5860 / PLN 2800 / RUB 43160 / SEK 6330 / CHF 715 / GBP 500 (“Second Runner-Up Prize”).

 

35.          Each Third Runner-Up will win one (1) PES 2015: Pro Evolution Soccer PlayStation®4 Disc Game with an approximate value of EUR 54 / CZK 1494 / DKK 406 / HUF 16444 / NOK 469 / PLN 224 / RUB 3453 / SEK 506 / CHF 57 / GBP 40 (“Third Runner-Up Prize”).

 

36.          The Promoter will use reasonable endeavours to send by registered post, the Second Runner-Up Prize to each Second Runner-Up and the Third Runner-Up Prize to each Third Runner-Up, within four (4) week of receiving a Second Runner-Up or Third Runner-Up’s details.

 

37.          In these Terms, (“Prize”) shall mean a Winner Prize, a First Runner-Up Prize, a Second Runner-Up Prize or a Third Runner-Up Prize, as appropriate in the context.

 

38.          Prizes must be taken as stated and may not be deferred. There will be no cash alternatives; however the Promoter reserves the right to substitute any Prize with a prize of a similar value.

 

39.          The Promoter cannot accept any responsibility whatsoever for any technical failure or malfunction or any problem which may result in any Competition entry or other correspondence being lost or not being properly registered.

 

40.          In the event of a dispute, the Promoter’s decision is final and no correspondence or discussion will be entered into.

 

41.          The Promoter reserves the right to cancel the Competition or amend these Terms at any stage, if deemed necessary in its opinion or if circumstances arise outside its control.

 

42.          If a Prize is found to be ineffective, faulty or damaged upon receipt, the Promoter must be notified in writing within seven (7) days of receipt, otherwise the Prize will be deemed to be accepted as received.  This does not affect the Winner’s, the First Runner-Up’s, a Second Runner-Up’s or a Third Runner-Up’s statutory rights (if any).

 

43.          The Winner and their Companion, the First Runner-Up and their Companion, each Second Runner-Up and each Third Runner-Up agrees to take part in any reasonable publicity required by the Promoter. In particular, the Promoter may want to film the Winner and their Companion at the Winner Event and the First Runner-Up and their Companion at the First Runner-Up Event.  By attending an Event, the Winner and their Companion and the First Runner-Up and their Companion will be deemed to give the Promoter, and its associated companies, licensees and assignees, permission to:

a)     photograph, film and record them during their visit;

b)    edit, alter, reproduce, publish and distribute any such photographs, recordings and films or anything derived from them (“Material”) in any medium; and

c)     use the Material, in whole or in part, on a worldwide basis and free of charge in perpetuity, for any purposes it deems necessary to promote, advertise or exploit any of Promoter’s products and/or services and anything connected with or derived from them.

 

44.          The Winner and their Companion and the First Runner-Up and their Companion also agree to waive any moral rights that they may have in the Material and to release the Promoter and its associated companies, licensees and assignees from any claims for payment in connection with their use of the Material.

 

45.          If there is any reason to believe that there has been a breach of these Terms or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may in its sole discretion refuse to process an entry or fulfill any Prize awarded. If an Entrant fails to comply with clauses 4, 5, 6, 9, 21 and/or 33, or uses multiple accounts to enter, they will be excluded from the Competition and their entry will be declared void.

 

46.          The Winner, the First Runner-Up, each Second Runner-Up and each Third Runner-Up may be required to pay tax on any Prize won in accordance with their jurisdiction’s tax legislation and will be responsible for any related tax liability.

 

47.          The Winner and their Companion and the First Runner-Up and their Companion must ensure that they comply with the relevant rules of entry when attending the Winner Event or the First Runner-Up Event.  Any refusal of entry is not the responsibility of the Promoter and the Promoter shall have no liability to the Winner and/or the First Runner-Up in respect of the same.

 

48.          The Promoter may, at its sole discretion, publish the Winner’s, the First Runner-Up’s, each Second Runner-Up’s and each Third Runner-Up’s name on the Promoter’s website(s). The Winner’s, the First Runner-Up’s, each Second Runner-Up’s and each Third Runner-Up’s name will be made available on reasonable request to those enclosing a self-addressed envelope marked “UEFA Champions League Fans’ Final” to the following address: Sony Computer Entertainment Europe Limited, 10 Great Marlborough Street, London W1F 7LP United Kingdom within six (6) weeks of the Closing Date.

50.          The “Promoter” is: Sony Computer Entertainment Europe, 10 Great Marlborough Street, London W1F 7LP United Kingdom.

 

51.          To the extent permitted by applicable law, these Terms shall be construed and interpreted in accordance with the laws of England and the contract between each Entrant and the Promoter shall be deemed to have been formed and performed in England.
