Terms and Conditions – Specific Rules for “FIA Certified Gran Turismo™ Championships 2019” Competition – EMEA Region

 

Competition and Entry Requirements

 

1.            The “FIA Certified Gran Turismo™ Championships 2019”  competition (“Competition”) is open to persons who meet the Minimum Age Requirement (as defined below) and who are residents of Austria, Bahrain, Belgium, Czech Republic, Denmark, France, Finland, Germany, Hungary, Ireland, Italy, Lebanon, Kuwait, Netherlands, Norway, Oman, Poland, Portugal, Qatar, Russia, Saudi Arabia, Slovakia, Spain, Sweden, Switzerland, the UAE and the UK (“Entrant Countries”) except employees, agents, contractors or consultants of the Promoter (as defined below) and their immediate families, the Promoter's associated companies and anyone else professionally connected with the Competition (“Entrants).

2.            The minimum age requirement is 18 years to those Entrants who are residents of Austria, Bahrain, Belgium, Czech Republic, Denmark, Finland, France, Germany, Hungary, Ireland, Italy, Lebanon, Netherlands, Norway, Oman, Poland, Portugal, Qatar, Russia, Slovakia, Spain, Sweden, Switzerland, and the UK and 21 years or older to those residents of Saudi Arabia, Kuwait and the UAE (the “Minimum Age Requirement”).

3.            These Terms (as defined below) apply to those Entrants who are resident of the Entrant Countries, other than France.

4.            The Competition opens for entries on 23 March 2019 at 16.45 GMT ("Opening Date") and last entries must be before 07 September 2019 at 23.59 GMT ("Closing Date").  See Schedule 1 for more information.  The period from the Opening Date to and including the Closing Date shall be referred to as the “Competition Period.

5.            In order to enter the Competition, Entrants must complete the GT Sport Mode registration form which shall be presented to Entrants who select the ‘Sport’ mode within the Game during the Competition Period (each an “Entry”).  Entrants will need to specify which Championship they wish to compete for, at the commencement of each race.

6.            The Competition consists of two (2) different championships (each a “Championship”):

                    a.   FIA GT Championships Nations Cup (hereafter referred to as the “Nations Cup”): The Nations Cup is a championship in which countries and territories will compete for victory. The country and territory of a player's affiliation will be automatically decided by the country/territory of their account for PlayStation™Network. There are no restrictions on the country of origin of the cars that will be driven; and

                     b.   FIA GT Championships Manufacturer Series (hereafter referred to as the “Manufacturer Series”): The Manufacturer Series is a championship in which Entrants race using cars made by one type of manufacturer. Entrants will race to be the best racers for their manufacturer and will then race to beat Entrants who represent other manufacturers. Entrants shall choose their manufacturer from a predetermined list of twenty-five (25) manufacturers.

Details of each Championship are set out in Schedule 1 (Nations Cup) and Schedule 2 (Manufacturer Series), respectively. 

7.            The Competition is free to enter and no purchase of any kind is necessary but Entrants must own or have access to a PlayStation®4 and a copy of Gran Turismo™ Sport for PlayStation®4 (“Game”). Entrants must be active PlayStation®Plus members during the Competition Period. By entering the Competition, Entrants accept and will be bound by these terms and conditions (“Terms”) as well as the General Rules (click here).

8.            Registration for PlayStation™Network (“PSN”) is subject to acceptance of the PSN Terms of Service and User Agreement and PSN Privacy Policy. (http://eu.playstation.com/legal/).

9.            Each Entrant may only submit one (1) entry per Championship.  For the avoidance of doubt, races listed under each Championship racing calendar, shall be at different times.  It is therefore possible for Entrants to compete in both Championships and for the winner of the Nations Cup to also be part of the winning team in the Manufacturer Series.

10.          It is prohibited for Entrant(s) to create duplicate accounts in order to compete or to increase their chances of qualifying or progressing through the Competition.  In such event, the Promoter reserves its right, at its sole discretion to disqualify such Entrant(s).

11.          Competition winners are defined in Schedule 1 (Nations Cup) and Schedule 2 (Manufacturer Series) in accordance with the relevant Championship mechanic (each a “Winner”). Competition runners-up are defined in Schedule 1 (Nations Cup) and Schedule 2 (Manufacturer Series) in accordance with the relevant Championship mechanic (each a “Runner-Up”).

12.          Prizes are as defined in Schedule 1 (Nations Cup) and Schedule 2 (Manufacturer Series), as applicable, and must be taken as stated and may not be deferred. There will be no cash alternatives; however, the Promoter reserves the right to substitute any Prize with a prize of a similar value.

13.          The Promoter cannot accept any responsibility whatsoever for any technical failure or malfunction or any problem which may result in any Competition entry or other correspondence being lost or not being properly registered.

14.          PlayStation®Plus subscription only available for accounts for PlayStation™Network with access to PlayStation™Store and high-speed internet.  PSN, PS Store and PS Plus subject to terms of use and country and language restrictions; PS Plus content and services vary by subscriber age. Users must be 7 years or older and users under 18 require parental consent, except that users in Germany must be 18 years or older. Service availability is not guaranteed. Online features of specific games may be withdrawn on reasonable notice - eu.playstation.com/gameservers. PS Plus subscription automatically renews at the end of the subscription period at the current PS Store price.  Full terms apply: PSN Terms of Service at eu.playstation.com/legal.

15.          In the event of a dispute, the Promoter’s decision is final and no correspondence or discussion will be entered into.

16.          The Promoter reserves the right to cancel the Competition or amend these Terms at any stage, if deemed necessary in its opinion or if circumstances arise outside its control.

17.          If any Prize is found to be ineffective, faulty or damaged upon receipt, the Promoter must be notified in writing within seven (7) days of receipt, otherwise the Prize will be deemed to be accepted as received.  This does not affect a Winner’s and/or a Runner-Up’s statutory rights (if any).

18.          Each Winner and Runner-Up agrees to take part in any reasonable publicity required by the Promoter.

19.          If there is any reason to believe that there has been a breach of these Terms or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may in its sole discretion refuse to process an entry or fulfill any Prize awarded. If an Entrant fails to comply with these Terms, including but not limited to clauses 1, 2, 7, 8, 9, 19 and/or Schedule 1 or Schedule 2 or uses multiple accounts and/or any automated system to enter, they will be excluded from the Competition and their entry will be declared void.

20.          Each Winner and each Runner-Up may be required to pay tax on any Prize won in accordance with their jurisdiction’s tax legislation and will be responsible for any related tax liability.

21.          The Promoter may, at its sole discretion, publish each Winner’s and each Runner-Up’s name on the Promoter’s website(s).  Each Winner’s and each Runner-Up’s name will be made available on reasonable request to those enclosing a self-addressed envelope marked ‘FIA Gran Turismo™ Championships 2018’ to the following address: Sony Interactive Entertainment Europe Limited, 10 Great Marlborough Street, London W1F 7LP United Kingdom within six (6) weeks of the Closing Date.

23.          The “Promoter” is: Sony Interactive Entertainment Europe Limited, 10 Great Marlborough Street, London W1F 7LP United Kingdom.

24.          To the extent permitted by applicable law, these Terms shall be construed and interpreted in accordance with the laws of England and the contract between each Entrant and the Promoter shall be deemed to have been formed and performed in England.

 

Schedule 1 – Nations Cup

 

1.         The Nations Cup Online Series

1.1          Entrants shall enter the Competition by playing in the Nations Cup Online Series set of races via the ‘Sport’ mode within the Game. Entrants must select and confirm they want to participate in the Nations Cup prior to starting each race.

1.2          The Nations Cup Online Series shall consist of four (4) Stages, each with ten (10) Rounds, as detailed here:

1.3       Race dates denoted with an * mark indicate the “Top 16 Superstars” races (as described in paragraph 1.8 of this Schedule 1).

1.4       Entrants shall be awarded points based on:

1.4.1    their final position in each race; and

1.4.2    the average driver rating of the Entrants they race against in each race.

1.5       Points will be tallied at the end of a series of Rounds, under each Stage, as follows (the “Final Score”):

Nations Cup: Entrants must participate in races during the Nations Cup Online Series to gain points which shall be used to calculate their overall ranking. Each Entrant’s overall ranking shall determine whether they will be invited to World Tour Live Events and progress within the competition. Entrants’ Final Score shall be calculated as follows:

Stage 1: The Final Score is tallied from the Entrant’s best three (3) Rounds, out of ten (10) Rounds (cumulative from Round 1 to Round 10).

Stage 2: The Final Score is tallied from the Entrant’s best five (5) Rounds, out of twenty (20) Rounds (cumulative from Round 1 to Round 20).

Stage 3: The Final Score is tallied from the Entrant’s eight (8) best Rounds, out of thirty (30) Rounds (cumulative from Round 1 to Round 30).

Stage 4: The Final Score is tallied from the Entrant’s ten (10) best Rounds, out of forty (40) Rounds (cumulative from Round 1 to Round 40).

Entrants may participate in any race, at any Stage at their discretion.  However, only the points earned in the last race of the day will count towards their Online Ranking for that Round. (i.e. if an Entrant competes in three races in Round 7 on 13 April 2019, only the points earned in the last race (3rd) will be counted).

1.6       The Final Score applicable to each Stage, determines the position of each Entrant in the “Online Ranking”.

1.7       Star Players

1.7.1    Subject to paragraphs 1.7.2 and 1.7.3 below, Entrants shall be eligible to register as a Star Player if they are either:

1.7.1.1 in the top 200 in the Online Rankings at the end of the previous Stage; or           

1.7.1.2 in the top 10 in the Online Rankings in their Entrant Country.

1.7.2    Once an Entrant meets one of the conditions set out in paragraph 1.7.1 of this Schedule 1, they shall receive an in-game notification on Gran Turismo™ Sport, notifying them that they are eligible. Once they have received this notification, Entrants may register to become a Star Player by visiting gran-turismo.com.  It is the Entrant’s responsibility to actively register as a Star Player.

1.7.3    Registered star players (hereafter referred to as “Star Players”) shall have an ‘S’ driver rating and shall be eligible to participate in the “Top 16 Superstars” race set out in paragraph 1.8 of this Schedule 1.

1.7.4    Once an Entrant has earned a Star Player driver rating, their rating shall apply to their driving profile for one successive Stage of the Online Series only.

1.8       Top 16 Superstars Race

1.8.1    Top 16 Superstars Races shall take place periodically throughout the Online Series. In accordance with paragraph 1.3, Superstar races are marked with an * mark in the race schedule at paragraph 1.2.

1.8.2    Entrants who compete in the “Top 16 Superstars” races shall be eligible to win bonus points during the Online Series.

1.8.3    Each Entrant must be a Star Player to register for a “Top 16 Superstars” race.

1.8.4    Entrants may register to join a “Top 16 Superstars” race up to fifteen (15) minutes prior to the scheduled start of each race.

1.8.5    For each “Top 16 Superstars” race, the 16 most highly ranked Star Players who have registered for the applicable race shall be selected to participate. This ranking may be based on each Entrant’s driver rating or the total number of points acquired in the applicable season. The way in which Star Players are ranked for the purposes of “Top 16 Superstars” race selection shall be defined prior to the start of each “Top 16 Superstars” race.

1.8.6    For the Nations Cup, there can be no more than two (2) Star Players from each Entrant Country who can race in a “Top 16 Superstars” race.

1.8.7    If prior to the start of a “Top 16 Superstars” race, fewer than 16 Star Players have been selected, the restrictions set out in paragraphs 1.8.5 and 1.8.6 shall no longer apply. Star Players will thereafter be selected based on their Online Ranking, as applicable.

1.9       Following the end of each Stage, ten (10) competitors from the EMEA Region shall proceed to the Nations Cup World Tour Live Event (each a “World Tour Finalist”).

1.10       World Tour Finalists will win:

1.10.1   an invitation to attend and participate in the next World Tour Live Event (as defined in paragraph 2.1 of Schedule 1);

1.10.2   return economy class flights, coach tickets or train tickets to the World Tour Event (as applicable, in the Promoter’s sole discretion);

1.10.3   accommodation for the duration of the World Tour Live Event (choice of accommodation, at the Promoter’s sole discretion);

1.10.4   transport to and from the airport, bus terminal or train station (as appropriate) to the accommodation, on the dates of the inbound and outbound flights/buses/trains;

1.10.5   return transport from the accommodation to the venue of the relevant World Tour Live Event; and

1.10.6   all meals during the relevant World Tour Live Event,

information relating to travel and accommodation shall be confirmed by Promoter, and/or Polyphony Digital Inc. on behalf of the Promoter, by email following the end of each Stage (as set out in paragraph 1.2), (together the “Online Series Prizes”, each an “Online Series Prize”).

2.         Nations Cup World Tour Live Events

2.1       The Nations Cup World Tour Live Events are five (5) Live Events during which the World Tour Finalists shall race to determine the Nations Cup World Tour Winner for the EMEA Region (each a “Nations Cup World Tour Live Event”).

2.2       The Nations Cup World Tour Live Event shall take place at a date and location to be confirmed by the Promoter, and/or Polyphony Digital Inc on behalf of the Promoter, by email following the end of each Stage. The Nations Cup World Tour Live Events are expected to take place in March, June, August, September, October, and November 2019 in different cities around the world. 

2.3       The rules for each Nations Cup World Tour Live Event will be set out by Polyphony Digital prior to the commencement of each event.

2.4       The Nations Cup World Tour Finalists shall be:

2.4.1  for World Tour 1, twenty-four (24) Entrants selected from competitors who participated in the Nations Cup races at the World Final event of the 2018 FIA Certified Gran Turismo™ Championships (held on 16-18 November 2018 in Monaco), selected by ranking order of the results.

for World Tour 2, 3, 4, and 5, subject to the Country Cap as defined in paragraph 2.5 and subject to paragraph 2.6 below, the Entrants with the ten (10) highest Online Ranking position attained through competing in Nations Cup Online Series races, as per:

World Tour 2: based on the Online Ranking results at the end of Stage 1.

World Tour 3: based on the Online Ranking results at the end of Stage 2.

World Tour 4: based on the Online Ranking results at the end of Stage 3.

World Tour 5: based on the Online Ranking results at the end of Stage 4.

2.5       There shall be a maximum of two (2) World Tour Finalists per Entrant Country (the “Country Cap”), up to a maximum of ten (10) Entrants in total from the EMEA Region. Where an Entrant is ranked third in their Entrant Country, the next highest-ranking Entrant from a different Entrant Country shall advance to the EMEA Nations Cup World Tour. This means that an Entrant ranked 3rd or lower amongst the Entrants from their Entrant Country cannot be a World Tour Finalist even if their score is higher than an Entrant placed in the top 2 of another Entrant Country.

2.6       In the case where a World Tour Live Event is held in a country within the EMEA Region, two (2) further EMEA Entrants will be invited to that World Tour Event, selected according to their position in the Online Rankings.

2.7       Subject to the Country Cap set out in paragraph 2.5, in the event that a World Tour Finalist from the EMEA Region is unable to attend the World Tour Live Event, the Entrant with the next highest Online Ranking (who is not already a World Tour Finalist) may be invited to participate in the Nations Cup World Tour Live Event for the EMEA Region and shall be notified as such by Polyphony Digital Inc..

2.8       The “Nations Cup World Tour Final Winner” shall be the World Tour Finalist with the highest score from all applicable Nations Cup World Tour Live Event races. The “Runners-Up” shall be the World Tour Finalists with the second and third highest score from all applicable Nations Cup World Tour Live Event races.

2.9       World Tour Finalists with the highest most World Tour wins from all of the applicable Nations Cup World Tour Live Events (a “Nations Cup World Finalist”) shall proceed to the Nations Cup World Final. The Nations Cup World Final shall take place as a separate competition during the Gran Turismo™ Championships World Finals 2019 (“World Finals”) which is expected to take place in November 2019. The terms shall be sent to each Nations Cup World Finalist by email prior to the event taking place.

2.10     There shall be sixteen (16) Nations Cup World Finalists (as defined in paragraph 2.9 of Schedule 1) from the EMEA Region.  This will comprise any Nations Cup World Finalists, as selected per paragraph 2.9 (above) and those Entrants who achieved the highest Online Ranking at the end of Round 40.

2.11     There shall be a maximum of three (3) World Finalists per Entrant Country (the “Country Cap”), up to a maximum of sixteen (16) Entrants in total from the EMEA Region. Where an Entrant is ranked fourth in their Entrant Country, the next highest-ranking Entrant from a different Entrant Country shall advance to the World Final. This means that an Entrant ranked 4th or lower amongst the Entrants from their Entrant Country cannot be a World Finalist even if their score is higher than an Entrant placed in the top 3 of another Entrant Country.

2.12     In the event that a Nations Cup World Finalist is unable to attend the World Final, the World Tour Finalist with the next highest Online Ranking may be invited to become a Nations Cup World Finalist and shall be notified as such by Polyphony Digital Inc.

2.13     The Nations Cup World Finalists shall be notified of their selection after the conclusion of each World Tour Live Event and can choose to claim their Prize (as defined in paragraph 2.15, Schedule 1) at that time. The Promoter shall provide information relating to the World Final (as defined in paragraph 2.9) to the Nations Cup World Finalists by email to the email address provided by the Entrant in the GT Sport Mode registration form.

2.14       Each Nations Cup World Tour Winners will win:

2.14.1   an invitation to attend and participate in the “FIA Certified Gran Turismo Championships 2019” which is a live event during which the 2019 Nations Cup World Final and the 2019 Manufacturer Series World Final shall take place (the “World Finals”);

2.14.2   return economy class flights, coach tickets or train tickets to the World Finals (as applicable, in the Promoter’s sole discretion);

2.14.3   accommodation for the duration of the World Finals (choice of accommodation, at the Promoter’s sole discretion);

2.14.4   transport to and from the airport, bus terminal or train station (as appropriate) to the accommodation, on the dates of the inbound and outbound flights/buses/trains;

2.14.5   return transport from the accommodation to the venue of the World Finals; and

2.14.6   all meals during the World Finals event.

2.15     In addition to the invitation element of the Prize set out above, the Nations Cup World Tour Winners and Runners-Up shall also win a trophy.

2.16     Prizes listed in paragraphs 2.14 and 2.15 are the “World Tour Prizes”.

2.17     In order to claim the invitation to the World Final (as defined in paragraph 2.14), each Winner must respond appropriately to the Promoter’s notification email within two (2) weeks from the date of the Promoter’s notification email, and provide their full name, and date of birth.  The postal address provided must match any postal address provided at the time of entry, or a Winner may be disqualified.
