SEN and PSN Privacy Policy

Sony Interactive Entertainment Europe Limited and Sony Network Entertainment Europe Limited ("we" or "us") will collect personal information about you when you access or use the Sony Entertainment Network ("SEN") or its associated services including, but not limited to: the "PSN", the PlayStation®Store; the SEN store; game, movie, music and other services; and virtual communities. This Privacy Policy tells you how we will collect and hold this information, how this information is used and how you can contact us about this.

I/ GENERAL INFORMATION ABOUT THE PERSONAL INFORMATION WE COLLECT

1. Important notice about Network Monitoring
We cannot monitor the whole of SEN and make no commitment to do so. However, we reserve the right in our sole discretion to monitor and record your online activity and communication throughout SEN and to remove and/or delete any content from SEN at our sole discretion, without further notice to you, and you expressly agree that we may do so. Any information collected in this way, including the content of your voice and text communications, the time and location of your activities, and your PSN Online ID, registered account details and IP address, may be used by us to enforce the SEN Terms of Service, to comply with the law and to protect our rights and those of our licensors, users and others, and the personal safety of our employees, users and others. This information may be passed to the police or other appropriate authorities. By accepting this Privacy Policy or the SEN Terms of Service and User Agreement, you expressly consent to this.

2. What information do we collect?
We collect information when you create a SEN account sign in to it or use our other sites and services.

  • Information you provide to us

Registration information: when you create a SEN account, we collect information such as your name, date of birth and email address, country postcode, password and gender.

Your payment information: it is the information you provide when you buy funds for your SEN wallet or make any other payments via SEN using a payment card. We will store your payment card details, excluding the 3 or 4 digit security code, for future purchases, unless you remove them from your account via your SEN Account Management area. We will keep a record of payments into your SEN wallet and the purchases you make via SEN.

Contact information: when you contact our customer service centre for assistance we may keep information about the communications including your name, your contact details and we may record the calls.

We also receive information you provide when participating in market research surveys, competitions, promotions.

  • Information that we get from your use of SEN, products and services

Each time you sign in to or access SEN, we may collect information automatically without further notice to you, for example:

  • Your PSN Online ID
  • Your IP address and device MAC address (the unique numbers which identify the network and device you are using) and date and time of sign in;
  • Your current and recent locations, provided that you have given your consent to allow this;
  • Information about the device you are using and how you have used it, such as model and serial number, device settings (e.g. photograph, remote play, parental control);
  • How you use SEN, for example, what games or music you play, what content you browse, share or download, what services you access and for how long, including how often you use chat, message boards or other communication services;
  • Your gamer profile, game matching, uploaded scores and rankings, your Friends and block lists and your appearance on other user's Friends or block lists.

3. What do we do with your information?
We use your information to operate SEN and to provide the services you have requested. We may retain, use and disclose your personal information, subject to applicable laws, as described below:

  • To maintain your account, process your purchases and carry out credit checks, we will provide your payment details to banks and to other relevant third parties in order to complete your purchase and obtain payment;
  • To personalise the services we provide to you (for instance, we may use your IP address to display content relevant for your area or your transaction history to recommend products and services that we think will interest you on our online stores);
  • To send you important information such as communication about your purchases, your password or passcode reset, changes to the SEN Terms of Service or this Policy. Because they are important we will send you these communications even if you don't opt-in to receive marketing emails;
  • To run promotions, send marketing communications and serve ads on our network sites and third party sites, which may be targeted and personalised using your information;
  • To provide customer support and assistance services that you have requested;
  • To improve existing products and services, for example by optimising control layouts and bug and error fixing, and to design new products and services;
  • To prepare statistics about our consumers and their use of our products and services; and
  • To enforce the SEN Terms of Service and any rules or codes of conduct applying to your use of SEN, and for auditing, compliance and legal purposes.

We may combine the information that we collect about you and others and analyse it to better understand our consumers and their demographics, transactions and behaviour across all of our product and services. We use this analysis for the above purposes.

4. Who do we share your information with?
We will not rent or sell your personal information to any third parties. Except as described in this Policy, we will not disclose your personal information to third party without your consent.

Other Sony companies: your information will be available to other Sony group companies who need that information to provide you with services via, or in connection with, SEN.

Other websites, games and services: we may allow you to use your SEN account details to access third party game and application services and to log in to other applications and websites, such as third party game publishers, social networking and game consolidation websites. We may provide those third parties with access to some of your SEN account details (such as your PSN Online ID, country gender, age and "Friends" and block list) so they can operate and improve their services and websites. When you log in with your SEN account to access a third party service, you provide your details to us and we confirm your identity to the third party but never share your password or passcode. Those third parties should inform you about their use of your information for any other purposes and, where required by law, obtain your prior consent. We encourage you to access and read their privacy policy / notices before using any service or website provided by them. By using your SEN account details to log in to third party websites or online services, you confirm that you want us to share your account details in this way.

Service providers: your information will be available to companies who help us to provide SEN or other online services provided directly via your Sony device and to companies who process your payments for us. We may allow such companies to produce and retain aggregate, statistical information about how their services are used for their own purposes.

Business transfer: your information may be available to third parties during negotiations for a transfer of all or part of our business and may be transferred by us as part of that business.

Law enforcement: we may retain, use and/or disclose any of your information as required or permitted by law, regulation or order, including to the police or other appropriate authorities, to investigate complaints made by or against you, or to protect or defend ourselves, or others, against illegal, criminal or harmful activities.

5. Transfer of your information outside the European Economic Area

Your information will only be processed, stored and transferred to countries outside the European Economic Area (EEA), such as the United States, Japan, Australia and New Zealand for the purposes set out in this Privacy Policy. It will be processed by persons located outside the EEA and may be seen by other users in those countries. Data protection laws in these countries may not offer the same level of protection as in the EEA and you may have fewer legal rights in relation to your information. If you are not happy for this transfer to take place, you should not access and use SEN.

II/ SHARING YOUR PERSONAL INFORMATION PUBLICALLY
When you use SEN, certain types of your information are publically available.

1. Information always publically available: your profile information
PSN Online ID: when you register a master or sub account, you may choose a PSN Online ID. When you use PSN, your PSN Online ID is your public nickname and may be visible to all SEN users. Other users, such as people whom you meet or play online, can use your PSN Online ID to send you messages or chat. If you accept other users as your "Friends" in SEN, they can see what you are doing within SEN at any time. Your PSN Online ID, "About Me" statement, avatar, language, country and gaming scores and statistics may be displayed in SEN or on our or third party game related websites.

Name: When you create a SEN account or sign in to an account on PlayStation®4, you have the choice between displaying your name or your PSN Online ID. If you chose to display your name, this information will be available in the same way as we describe above for PSN Online ID. You can choose which "Friends", and whether "Friends of Friends", can see your name. But in some cases we may assume that you would prefer your name to be displayed (for instance, to a new "Friend" who accepts your email friend request sent via the official PlayStation app) and you will need to change your settings if you would prefer to display your PSN Online ID instead. Please be aware that anyone who can see your name will be able to share it with others, for example by sharing a gameplay video that you feature in (see below).

Profile picture: when you set up an SEN account on PS4™, you can upload a profile picture for your SEN account, in which case, this will be publically available.

Other images: if your device has a camera you may be able to upload or stream images of yourself and others.

Some devices allow users to record, stream and upload online activities such as gameplay and therefore may be distributed outside SEN without your knowledge, which means that you and we have no control over it.

Avoid sharing contact information on SEN.

2. Information you choose to share
You are responsible for any content you post on the SEN, and this content will be accessible to others.

PS4™ has some specific features:

"Share" button: you or the user you are playing with online can live stream your gameplay, or upload gameplay video and screen shots to third party websites or the public through the "share" button on your device system. Your personal information (including your PSN online ID, name and profile picture), text and voice chat may be captured and uploaded to the Internet.

Your activity feed: you can choose to share information about your SEN account activity such as your purchases, trophies earned and content accessed, or uploaded. This information is visible to SEN users through activity feeds.

Your choice: we provide privacy settings for your activity feed which you can set when you create your account or via your Account Management area.

We recommend you consider carefully whom you share your information with.

3. Our use of the information you choose to share publically
We and our affiliates may use the content that you share publically via our products and services for commercial and promotional purposes. Please see our software usage terms and SEN terms of service for more information.

III/ CHILDREN AND PARENTAL CONTROL

You must be at least 18 years old to create a SEN account. However, if you are a parent or guardian, you may create up to 6 sub accounts under your SEN account for your children aged 7 to 17 to access the SEN and some of its services.

Depending upon the registered age of the sub account and local laws we may email you in order to confirm your consent to registration and to use their child's personal information as explained in this Privacy Policy. You may be able to access to certain information about the use of your Sub Accounts, including details of Sub Account transactions and communications, and you should explain this to your Sub Account users.

You can use our parental controls to tailor your sub account's use of the SEN (e.g. preventing them from chatting online). See https://eu.playstation.com/parents for more details.

Supervise your children's use of devices and the SEN at all times.

IV/ ADVERTS AND COMMUNICATION PREFRENCES
We target and personalise our marketing communications and the adverts we display on our and third party websites and services based on information you included in your profile and about your use of our products and services.

1. Display of Adverts
We may use the information we collect about you to personalise our online stores, services, content, recommendations, marketing and adverts. You may notice this personalisation when you use our products and services, when we send you marketing communications or when you visit our and third party websites that show content, recommendations or adverts from us (for example, you might see an adverts for a product that you have recently viewed on one of our websites or services).

2. Reviewing your details and communication preferences
You can view or edit your personal information, including billing and account information, privacy settings, online safety and data sharing preferences by accessing your SEN Account Management area.

Your marketing choices:

  • If you want to opt-out of receiving emails with information about our products and services, you can do so:
    • via your SEN Account Management area; or
    • by following the instructions and/or the link "unsubscribe" attached to our marketing emails.
    We will aim to process your request as soon as reasonably practicable and in any event, within 28 days. Note that we will still send you important emails even if you opt-out of marketing emails.

V/ COOKIES AND TRACKING PIXELS
We may collect information about your use of our websites, services, emails and adverts via cookies, tracking pixels and similar technologies. By accepting the SEN Terms of Service and User Agreement and this Privacy Policy, you consent to this processing as explained below.

Cookies

Cookies are small text files that we (or our third party partners) store or access on your device when you receive our websites, services, emails and adverts. They usually contain a unique number assigned by us (or our third party partners). This allows you to be recognised and your preferences and behaviour to be recorded.

What type of cookies do we use?

"Session ID" cookies

These cookies enable your actions to be linked in order to display the website correctly and to provide services that you request. These cookies are only active whilst you are on the website and do not remain on your device once the browser session is closed.

"Browsing experience" cookies

These cookies enable us to store non-identifying user preferences, such as your language, country and age and are used to enhance the browsing experience and display appropriate content. Some of these cookies will remain for the length of the session, while others (such as language preferences) will persist on your device to allow the same preferences to be displayed on your next visit to our sites.

"Web analytics" cookies

These cookies enable us to store anonymous data about how users interact with our websites, services, emails and advertisements in order to understand how they are used and to improve them. These cookies will persist on your device once your session is closed.

"Single –sign on" cookies

If you sign in to your SEN account, we will use a cookie to enable you to visit other related sites operated by or on behalf of Sony Network Entertainment Europe Limited and Sony group companies without having to sign in again. When you will return to one of these SEN related sites you will automatically be signed in. This cookie expires 60 days after the date you first sign-in to one of the SEN related sites. If you share your device with other users or if you don't want to be automatically signed in, we suggest that you sign out every time you visit one of the SEN related sites.

"Social plug-in" cookies

If you have signed in to a social networking site, such as Facebook, they may have set a cookie on your device which recognises when you view content on our sites. These cookies allow you to share content across social media via the use of sharing settings.

"Personalisation" or "Targeting" cookies

We use these cookies to recognise you and record your behaviour when interacting with our websites, services, emails and adverts. We and our third party partners use this information to target or personalised content and adverts sent or displayed to you, and control the number of times a particular advert is displayed. For example, we may advertise relevant products to you defined by what you have previously viewed, searched or clicked when you interacted with our websites, services, emails or advertising.

How do you opt-out of cookies?

In general, you can change your browser settings to control how cookies are accessed and stored on your device. See the help section of your web browser. As cookies enhance site usability and processes, if you disable them the website may not operate as expected and you may not be able to access certain functions.

Some of our websites, services and devices offer specific opt-out settings for non-essential cookies.

In addition, in some regions you can choose to opt-out of behavioural or targeting advertising cookies for certain third party advertising networks, which we may use, via advertising industry opt-out sites (for example: www.YourOnlineChoices.eu in Europe).

Tracking pixels

Tracking pixels, also known as web beacons, clear gifs technology or action tags, may be used on our websites and communications. We (and other third party partners) use this technology to determine which users have opened our emails or clicked on key elements (such as links or graphics) on a web page or in an email. We use this information to optimise our content, services and communications. For example, we may use the information to decide when and how often to send you marketing communications and to determine what content to advertise to you.

Some email clients and web browsers can also be configured to stop pictures being downloaded automatically and this will also prevent the tracking pixel from functioning (until you decide to download the pictures). Some tracking pixels work with cookies and in such cases can also be turned off by disabling cookies (as outlined above).

VI/ SECURITY
We will take appropriate technical and organisational steps to prevent unauthorised access to or disclosure of your information. However, we cannot guarantee that we will eliminate all risk of misuse of your personal information. You are responsible for keeping your password or passcode secret to prevent unauthorised access to and use of your SEN account and any payment details which you have saved for your account. We ask you not to share your password or passcode with anyone and to avoid using the same password that you use for other online websites or services. Remember to turn "Save Password" off before letting anyone else use your SEN account or giving your PSP™ (PlayStation®Portable), PlayStation®3 or PlayStation®Vita computer entertainment system, personal computer, BRAVIA® television or Blu-ray™ Disc player to anyone else, including for return to a shop or for repair.

If you use PS4™, it will automatically sign you in once your account is created, that means that you will be automatically signed-in when you switch on your PS4™. If you are using a shared device, we recommend that you set a passcode to prevent unauthorised access to your account by going to your Account Management area.

VII/ PERSONAL INFORMATION ACCESS REQUEST
Where you require access to information we hold about you, we will require you to put your request in writing and provide proof of identity and you may be charged an administration fee, subject to applicable laws. VIII/ CHANGES TO THIS PRIVACY POLICY
We may make changes to this Privacy Policy from time to time. To access a printable, current copy of this Privacy Policy, go to www.eu.playstation.com/legal or www.sonyentertainmentnetwork.com. Please check regularly to ensure that you are aware of any changes.

You will be notified of material changes by a posting as you sign in to SEN or by email to your current email address as registered on SEN. Your continued use of SEN (via a master account or sub account) after any changes signifies your acceptance of these changes. If you do not accept changes to this Privacy Policy you must stop using SEN. If you are a master account Holder and there are funds remaining in your wallet, you must contact us and we will close your account (and any associated sub accounts) and refund any unused wallet funds. You will not be able to access SEN.
