OFFICIAL RULES AND REGULATIONS
NO PURCHASE IS NECESSARY TO ENTER OR WIN THE PRIZE IN THIS CONTEST.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

1.         CONTEST PERIOD: 
The Win a Trip to PlayStation® Experience Contest (“Contest”) begins on October 19, 2015 at 11:00:01 a.m. Eastern Time (“ET”) and ends on November 6, 2015 at 11:59:59 p.m. ET (“Contest Period”). 

2.         ELIGIBILITY:
The Contest is open to all residents of Canada who are the age of majority in their province or territory of residence at the time of entry.  Employees, officers, directors, representatives or agents, as well as those with whom such persons reside, whether related or not, and members of the immediate family (mother, father, brothers, sisters, sons, daughters and spouse, regardless of where they reside) of Sony Computer Entertainment Canada Inc. (“Sponsor”), its advertising/promotion/web design agencies, Twitter, Inc. (“Twitter”), Facebook, Inc. (“Facebook”), the prize suppliers and any entity involved in the development, production, implementation, administration or fulfillment of the Contest, and each of their respective parent companies, subsidiaries, affiliates (including, with respect to the Sponsor, Sony Computer Entertainment America LLC) (collectively, the “Contest Parties”) are not eligible to enter or win a prize in this Contest.

3.         ENTRY:
No purchase necessary.  To participate in this Contest, entrants must have a valid Twitter or Facebook account.  Entrants who do not have a Twitter or Facebook account can visit twitter.com or facebook.com, as applicable, (each a “Website”, collectively the “Websites”) and follow the instructions provided to register for a free account.

To enter using Twitter during the Contest Period, submit a Tweet, a link to an original photograph or video, or upload a photograph during the Contest Period from your Twitter account.  To be eligible, your Tweet must tag @PlayStationCA and include the hashtag WinATrip2PSX; comply with the Twitter Terms of Service and Twitter Rules available at the Website; conform to Twitter’s 140 character limit, including the hashtag, and describe (or show) why you are PlayStation’s biggest fan.

To enter using Facebook during the Contest Period, visit the PlayStation Canada Facebook Page at facebook.com/PlayStationCanada (English) or facebook.com/PlayStationCanadaFr (French).  In the comment section of any PlayStation Canada Contest post made during the Contest Period, post a comment, a photograph, or a link to an original video or photograph showing why you are PlayStation’s biggest fan. To be eligible, any comment submitted must comply with all applicable Facebook Terms and Policies, copies of which are available at the Website.

Each entrant will receive one (1) entry (each an “Entry”, collectively “Entries”) when the entrant enters the Contest using one of the methods described above and in accordance with these Official Rules and Regulations (“Rules”).  Any Entry that does not follow the above format as determined by Sponsor will be ineligible for entry in this Contest.  Entries must not infringe, misappropriate or violate any third party’s rights, including, without limitation, copyright, trademark, right of publicity, right of privacy or trade secret and not contain any content that is offensive, illegal, obscene or that is otherwise objectionable to Sponsor, in its sole discretion.  By submitting an Entry in this Contest, each entrant certifies that the Entry submitted constitutes the entrant’s own unpublished work, and agrees to transfer all copyright to the Sponsor, and to waive all moral rights in and to such work.  Further, the entrant confirms by submitting an Entry that no other person has any intellectual property rights or other interest in the Entry submitted and, further, confirms that in the event the entrant is a winner in the Contest, acceptance of the Prize will not result in the winner breaching the terms of any other agreement with a third party.  For greater certainty, each entrant shall indemnify the Released Parties (as hereinafter defined) against any liability for any claims and associated costs that may be brought against them by any third parties with respect to any intellectual or other property rights in the submitted Entry.

Standard data usage rates may apply to entrants who submit an Entry via a wireless mobile device.  Wireless service providers may charge for airtime for each standard text message sent and received.  Contact your service provider for pricing and service plan information and rates before mobile device participation.

PHOTO AND VIDEO GUIDELINES: In submitting a photograph or a link to a photograph or a video as part of an Entry in this Contest, each entrant agrees that the photograph or video complies with these Rules including all guidelines provided in this Rule.  The Released Parties bear no liability in connection with the use of any photograph or video by them or any of them and shall be held harmless by each entrant in the event it is subsequently discovered that an entrant has not complied with any of these guidelines, in whole or in part.

Photographs and videos must comply with the following guidelines:

(a) Photographs or videos must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity.  Photographs and videos must not contain or reference any names, products or services of any company or entity other than Sponsor (or an affiliate of the Sponsor) or any third party trademarks, logos, or promotion of any brand, product or service.  Photographs and videos may not violate any law, statute, ordinance or regulation;

(b) Entrants are solely responsible for obtaining, prior to submitting a photograph or a link to a photograph or video, any and all releases and consents necessary to permit the publication, exhibition and/or use of the photograph or video by Sponsor in accordance with these Rules. If any person appearing in any  photograph or video is under the age of majority in his/her jurisdiction of residence, the consent of such person’s parent or legal guardian is required before the link to the photograph or video may be submitted;

(c) Photographs or videos that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contain inappropriate content or objectionable material may not be submitted and may be removed at any time in Sponsor's sole and unfettered discretion; and

(d) Entrants may not be, nor may they work with parties in conjunction with a photograph or video who are:(i) represented under a contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display a photograph or video in any media form; (ii) subject to an acting or modeling contract that would make a party’s appearance in a submitted photograph or video a violation of any third-party rights; or (iii) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsor from being able to use the photograph or video in all media in perpetuity on a royalty-free basis, without any payment or fee obligations.

By entering the Contest, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the submitted photograph or video, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her photograph or video in favour of the Sponsor; and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any related cause of action.

4.         ENTRY SUBMISSION:
There is a limit of one (1) Entry per Twitter or Facebook account permitted per day during the Contest Period.  For greater certainty, entrants can only use one (1) Twitter account and/or one Facebook account to participate.  Each Entry must be original and cannot be a duplicate, in whole or in part, of an Entry previously submitted in this Contest by an entrant.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor), that any person has attempted to: (i) obtain more than one (1) Entry per Twitter or Facebook account per day during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities, accounts, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then said entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Released Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).

All Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (a) for the purposes of verifying an individual’s eligibility to participate in this Contest; (b) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

During the Contest Period selected photographs and/or videos from Entries submitted may be posted on the PlayStation Canada Twitter or Facebook pages.  Such postings may be on a rotating or occasional basis and may be discontinued at any time in Sponsor’s sole discretion. Posting of an Entry at this phase of the Contest Period is not meant to indicate that the entry is a winner, or selected entrant in the Contest, or that it is otherwise favoured in any way.  Postings will occur solely for promotional purposes. 

5.         PRIZES:
There are three (3) prizes (each a “Prize”, collectively “Prizes”) available to be won in the Contest, each consisting of a trip for two (2) to the PlayStation Experience event in San Francisco, California, USA held December 5-6, 2015.  Each Prize includes:

  1. return economy airfare departing from the Canadian international airport nearest the winner’s residence to San Francisco, California – San Francisco International Airport (departure and destination airports, carrier and airline ticket class to be chosen and confirmed by the Sponsor);
  2. roundtrip ground transportation between Rio San Francisco International Airport and the hotel (hotel will be selected by the Sponsor);
  3. four (4) night’s hotel accommodation in a standard room, based upon double occupancy.  Winner and guest check-in will take place on December 4, 2015 and check-out will take place December 7 2015; and
  4. Eight Hundred Canadian Dollars (CAD$800) spending money for the winner.

The total approximate retail value of each Prize is Four Thousand Four Hundred Canadian Dollars ($4,400 CAD) based on a Toronto, ON departure.  Actual retail value may vary depending on city of departure and fluctuations in airfare charges, hotel rooms, and other trip-related elements.  Any difference between the actual value of the prize and the stated approximate retail value (if less than the actual value) will not be awarded.  Participation in the Prize by the winner and guest will be filmed by the Sponsor or a representative thereof.

All Prize-related travel arrangements will be administered by Sponsor’s authorized designee. Prize travel is subject to capacity controls, availability, weather, seasonal influences and certain other restrictions, all of which are subject to change. Guests must stay in the same hotel room as the winners. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. All airline tickets issued in conjunction with each Prize are not eligible for upgrades, frequent flyer miles or any other promotional benefit. Sponsor will not replace any lost or stolen tickets (including any event tickets or admission passes), travel vouchers, cash, certificates or similar items once they are in a winner’s possession or in the possession of a guest. Sponsor will determine flight itinerary in its sole discretion. Once hotel and flight arrangements have been confirmed, no changes will be allowed except by Sponsor in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Rules and those set forth by Sponsor’s air travel prize supplier, as detailed in the passenger ticket contract issued by such supplier. If a winner elects to travel or partake in a prize with no guest, no additional compensation will be awarded to the winner. 

Each winner and his/her travel guest must each have proof of valid travel documents (including government-issued photo identification and/or passports required for international travel) prior to ticketing and the right to travel internationally and enter the United States of America.  All winner and guest passports must be valid for at least 6-months prior to their expiration dates.  Each winner’s guest must be a legal resident of Canada and have reached the age of majority in his/her province/territory of residence.  Each winner and his/her travel guest must travel on identical itineraries (including the same departure and return date) and are responsible for ground transfers to and from the winner’s or travelling guest’s residence and designated airport.  Air transportation and hotel accommodations must be taken together and cannot be taken separately.  All other expenses not specified herein, including but not limited to: airport taxes, ground transportation to/from the departure airport in Canada, telephone or fax charges, gratuities, meals, beverages, optional tours, insurance, medical travel documents, personal expenses, stadium suites, hotel/personal incidentals, amenities, in-room charges (e.g. mini-bar, movies), photography, video, film, special entertainment, optional activities, gratuities, upgrades, and any other costs not specifically stated herein as being included, are the sole responsibility of the winner and his/her guest. Each winner will be required to provide a major credit card upon hotel check-in and all in-room charges will be charged to the credit card. Any damage to the room attributed to a winner and/or his/her guest will be the responsibility of the winner.  Each winner and his/her guest hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the Prize. It is the responsibility of each winner and his/her guest to arrive at the designated gateway airport in time for each flight that is part of the Prize.

Travel must be completed during the dates specified or a Prize will be forfeited. Sponsor bears no responsibility if any event, element or detail of a Prize is canceled, postponed or becomes unavailable for any reason. Should any event, element or detail of a Prize become unavailable, the Sponsor shall have no obligation to the winner aside from providing the travel portion of the Prize, minus any unavailable event, element or detail.  Each winner and his/her guest shall be subject to all terms and conditions printed on any ticket issues in conjunction with the Prize.  In the event a winner and/or guest is denied entry into any ticketed event or is removed or barred from any ticketed event location for any other reason, the Sponsor is not responsible and no further compensation or award will be provided.

Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion).  No substitutions except at Sponsor’s option.  Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or portion thereof with a prize or portion thereof of equal or greater value without liability.  A Prize will only be awarded to the person whose verifiable full name and valid email address appears on, or whose verifiable Twitter or Facebook account is the source of, the selected Entries.

6.         WINNER SELECTION:
On or about November 13, 2015, the Sponsor and/or its designated representative(s) (collectively, “Judges”) will review all eligible Entries received in the Contest.  The Judges’ review will rank each Entry based on a scale of one (1) to ten (10) (ten (10) being the best) for each of the following equally weighted categories:

1) Creativity:  How creatively does the Entry communicate that the entrant is PlayStation’s best fan?

2) Originality:  Is the Entry an original expression of the entrant’s love of PlayStation?

3) Relevancy:  Is the Entry relevant to the Contest theme?

The points awarded by the Judges in each category will be averaged to create one (1) score in each category for each entrant.  Each entrant’s overall score will then be determined by totalling the average scores he/she received in the “Creativity”, “Originality” and “Relevancy” categories.  The entrants that receive the top three (3) scores will be the winners (subject to eligibility verification).  If necessary, ties will be broken by comparing the individual scores for the “Originality” category. If there is still a tie after comparing “Originality” scores, the Judges will compare the scores in each of the remaining categories until the tie is broken using the following order: “Creativity” and “Relevancy”.

The Sponsor or its designated representative will make a minimum of five (5) attempts to contact the selected entrants within seven (7) business days of the Selection Date.  If a selected entrant cannot be contacted within seven (7) business days of the Selection Date, or if there is a return of any notification as undeliverable; then said selected entrant may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 

Before being declared A CONFIRMED PRIZE winner, each selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within seven (7) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; (iv) agrees to the incorporation by Sponsor any recording or part thereof in which the selected entrant appears in vision and/or sound into any film or program or series of films or programmes and grants to Sponsor the right to use and to license others to use any such recording in all media now or yet to be invented throughout the world in perpetuity; and (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.  If a selected entrant: (a.1) fails to correctly answer the skill-testing question; (b.1) fails to return the properly executed Contest documents within the specified time; (c.1) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (d.1) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).  Each selected entrant’s guest will also be required to sign and return Sponsor’s declaration and release form.

7.         GENERAL CONDITIONS:
No royalties, guarantees or advances (monetary or other) will be awarded for use by the Sponsor of the Entries of the winners or any entrant in this Contest.  All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.  By participating in this Contest, entrants agree to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

The Released Parties will not be liable for: (i) any failure of the Websites during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Twitter or Facebook account submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned a Twitter or Facebook  account by Twitter or Facebook, as applicable.  An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Twitter or Facebook accountassociated with the Entry in question.

The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux in Quebec to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. 

By entering this Contest, each entrant expressly authorizes the Sponsor and its agents and/or representatives, to store, share and use the personal information submitted with his/her Contest Entry for the purpose of administering the Contest, unless the entrant otherwise agrees.  Visit http://www.playstation.com/en-us/legal/privacy-policy for Sponsor’s Privacy Policy regarding collection, use and disclosure of personal information. 

Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, but with the consent of the Régie des alcools, des courses et des jeux to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.  In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.

Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

This Contest is in no way sponsored, endorsed or administered by, or associated with Twitter or Facebook. Entrants are providing their information to the Sponsor and not to Twitter or Facebook. The information provided by entrants for purposes of this Contest will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy.  Twitter and Facebook are released of all liability by each participant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Twitter or Facebook.
