OFFICIAL RULES AND REGULATIONS
NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE IN THIS CONTEST.

 

1.         CONTEST PERIOD: 
The PlayStation® Canada E3 Experience 2015 Live Stream Contest (“Contest”) begins on May 29, 2015 at 11:00:01 a.m. Eastern Time (“ET”) and ends on June 5, 2015 at 11:59:59 p.m. ET (“Contest Period”).

2.         ELIGIBILITY:
The Contest is open to residents of British Columbia, Ontario and Quebec who are 17 years of age or older at the time of entry.  Employees, officers, directors, representatives or agents, as well as those with whom such persons reside, whether related or not, and members of the immediate family (mother, father, brothers, sisters, sons, daughters and spouse, regardless of where they reside) of Sony Computer Entertainment Canada Inc. (“Sponsor”), its advertising/promotion/web design agencies, Twitter, Inc. (“Twitter”), Facebook, Inc. (“Facebook”), the prize suppliers and any entity involved in the development, production, implementation, administration or fulfillment of the Contest, and each of their respective parent companies, subsidiaries, affiliates (including, with respect to the Sponsor, Sony Computer Entertainment America LLC) (collectively, the “Contest Parties”) are not eligible to enter or win a prize in this Contest.  If an entrant is selected as a winner in the Contest, he/she is solely responsible for all costs and expenses associated with transportation to and from the E3 2015 Live Stream Event on June 15, 2015 in the city designated by the winner.

3.         ENTRY:
No purchase necessary.  To participate in this Contest, entrants must have a valid Twitter or Facebook account.  Entrants who do not have a Twitter or Facebook account can visit twitter.com or facebook.com, as applicable, (each a “Website”, collectively the “Websites”) and follow the instructions provided to register for a free account.

To enter using Twitter during the Contest Period, send a reply Tweet to @PlayStationCA from your Twitter account.  To be eligible, any Tweet submitted must:

  • include the following hashtag: #WatchE3Live, and the city from which you would like to watch the E3 2015 Live Stream (Toronto, Montreal or Vancouver);
  • comply with the Twitter Terms of Service and Twitter Rules available at the Website;
  • conform to Twitter’s 140 character limit, including the hashtag; and
  • include the answer to the question “What is your favourite PlayStation moment from a previous E3 and why?”

OR

To enter using Facebook during the Contest Period, visit the PlayStation Canada Facebook Page at https://www.facebook.com/PlayStationCanada and reply to PlayStation Canada’s Contest post answering the question “What is your favourite PlayStation moment from a previous E3 and why?”  To be eligible, any message submitted must comply with all applicable Facebook Terms and Policies, copies of which are available at the Website.

Each entrant will receive one (1) entry (each an “Entry”, collectively “Entries”) when the entrant Tweets an eligible reply Tweet or posts an eligible reply to PlayStation Canada’s Contest post on Facebook in accordance with these Official Rules and Regulations (“Rules”).  Any Entry that does not follow the above format as determined by Sponsor will be ineligible for entry in this Contest.  Entries must not infringe, misappropriate or violate any third party’s rights, including, without limitation, copyright, trademark, right of publicity, right of privacy or trade secret and not contain any content that is offensive, illegal, obscene or that is otherwise objectionable to Sponsor, in its sole discretion.  By submitting an Entry in this Contest, each entrant certifies that the Entry submitted constitutes the entrant’s own unpublished work, and agrees to transfer all copyright to the Sponsor, and to waive all moral rights in and to such work.  Further, the entrant confirms by submitting an Entry that no other person has any intellectual property rights or other interest in the Entry submitted and, further, confirms that in the event the entrant is the winner of the Contest, acceptance of the Prize will not result in the winner breaching the terms of any other agreement with a third party.  For greater certainty, each entrant shall indemnify the Released Parties (as hereinafter defined) against any liability for any claims and associated costs that may be brought against them by any third parties with respect to any intellectual or other property rights in the submitted Entry. 

Standard data usage rates may apply to entrants who submit an Entry via a wireless mobile device.  Wireless service providers may charge for airtime for each standard text message sent and received.  Contact your service provider for pricing and service plan information and rates before mobile device participation.

4.         ENTRY SUBMISSION:

There is a limit of five (5) Entries per Twitter or Facebook account permitted per day during the Contest Period.  For greater certainty, entrants can only use one (1) Twitter account or one Facebook account to participate.  Each Entry must be original and cannot be a duplicate, in whole or in part, of an Entry previously submitted in this Contest by an entrant.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor), that any person has attempted to: (i) obtain more than five (5) Entries per Twitter or Facebook account per day during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities, Twitter or Facebook accounts, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then said entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Released Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).

All Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (a) for the purposes of verifying an individual’s eligibility to participate in this Contest; (b) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

During the Contest Period, selected Entries submitted may be retweeted on the PlayStation Canada Twitter page.  Such postings may be on a rotating or occasional basis and may be discontinued at any time in Sponsor’s sole discretion. Posting of an Entry at this phase of the Contest Period is not meant to indicate that the entry is a winner, or selected entrant in the Contest, or that it is otherwise favoured in any way.  Postings will occur solely for promotional purposes.

5.         PRIZES:

There are six (6) prizes (each a “Prize”; collectively, “Prizes”) available to be won in the Contest, each consisting of two (2) tickets to the E3 2015 Live Stream in Toronto (two (2) Prizes available), Montreal (two (2) Prizes available) or Vancouver (two (2) Prizes available).  Each winner and his or her guest will also receive popcorn and non-alcoholic beverages to enjoy at the E3 2015 Live Stream, and a PlayStation prize package.  Three (3) Prizes will be randomly awarded from amongst the eligible Entries received on Twitter and three (3) Prizes will be randomly awarded from amongst the eligible Entries received on Facebook.  The approximate retail value of each Prize is One Hundred Canadian Dollars ($100 CAD).  No transportation, accommodation or meals will be provided in connection with the Prizes.

The Prizes must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion).  No substitutions except at Sponsor’s option.  Sponsor reserves the right, in its sole and absolute discretion, to substitute a Prize or a portion thereof with a prize or portion thereof of equal or greater value without liability.  A Prize will only be awarded to the entrant whose verifiable Twitter or Facebook account, as applicable, is the source of, the selected Entry.  Winners’ guests must also be 17 years of age or older in order to participate in a Prize.  If a winner’s guest is under the age of majority in his/her province of residence, the guest must have the consent of his/her parent or legal guardian in order to participate in the Prize. 

6.         WINNER SELECTION:

On or about June 10, 2015 (“Selection Date”) at the offices of the Sponsor at approximately 2:00 p.m. ET a random drawing will be held by the Sponsor to select six (6) potential winners from among all eligible Entries received.  Odds of winning will depend upon the number of eligible Entries received at the Website(s) where you entered (that is, on Twitter and/or on Facebook).

The Sponsor or its designated representative will make a minimum of five (5) attempts to contact the selected entrant (by direct message on Twitter or private message on Facebook) within two (2) business days of the Selection Date.  If the selected entrant cannot be contacted within two (2) business days of the Selection Date, or if there is a return of any notification as undeliverable; then said selected entrant may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 

Before being declared A CONFIRMED PRIZE winner, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.  If the selected entrant: (a.1) fails to correctly answer the skill-testing question; (b.1) fails to return the properly executed Contest documents within the specified time; (c.1) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (d.1) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).  If a selected entrant is a minor in his/her province of residence, then that entrant’s parent or legal guardian will be required to execute and return the Sponsor’s declaration and release form.  The selected entrant’s guest (or his/her parent or legal guardian, if applicable) will also be required to sign and return Sponsor’s declaration and release form. Prizes will be delivered to confirmed winners within two (2)-five (5) days of receipt of the fully completed declaration and release forms.

 

7.         GENERAL CONDITIONS:
No royalties, guarantees or advances (monetary or other) will be awarded for use by the Sponsor of the Entry of the winner or any entrant in this Contest.  All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.  By participating in this Contest, entrants agree to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

The Released Parties will not be liable for: (i) failure of any Website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Twitter or Facebook account, as applicable,submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned a Twitter account by Twitter or a Facebook account by Facebook.  An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Twitter or Facebook account associated with the Entry in question.

The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, with the consent of the Régie des alcools, des courses et des jeux (“Régie”) in Quebec, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion and with the consent of the Régie in Quebec) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation and with the consent of the Régie in Quebec, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. 

By entering this Contest, each entrant expressly authorizes the Sponsor and its agents and/or representatives, to store, share and use the personal information submitted with his/her Contest Entry for the purpose of administering the Contest, unless the entrant otherwise agrees.  Visit http://www.playstation.com/en-us/legal/privacy-policy for Sponsor’s Privacy Policy regarding collection, use and disclosure of personal information.  

Sponsor reserves the right, in its sole and absolute discretion (with the consent of the Régie in Quebec), and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.  In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.

Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

This Contest is in no way sponsored, endorsed or administered by, or associated with Twitter or Facebook. Entrants are providing their information to the Sponsor and not to Twitter or Facebook. The information provided by entrants for purposes of this Contest will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy.  Twitter and Facebook are released of all liability by each participant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Twitter or Facebook.
