OFFICIAL RULES AND REGULATIONS
NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE IN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. CONTEST PERIOD:
The PlayStation® Canada 2022 PLAYOFF TAILGATE CONTEST Contest (“Contest”) begins on April 13, 2022 at 12 p.m. Eastern Time (“ET”) and ends on April 28 at 11:59 p.m. ET (“Contest Period”).
The Contest is open to all residents of Ontario who have reached the age of majority in their province of residence at the time of entry. Employees, officers, directors, representatives or agents, as well as those with whom such persons reside, whether related or not, and members of the immediate family (mother, father, brothers, sisters, sons, daughters and spouse, regardless of where they reside) of Sony Interactive Entertainment Canada Inc. (“Sponsor”), its advertising/promotion/web design agencies, prizing partners, Facebook, Inc. (“Facebook”), Instagram, LLC (“Instagram”), Twitter, Inc. (“Twitter”), the prize supplier and any entity involved in the development, production, implementation, administration or fulfillment of the Contest, and each of their respective parent companies, subsidiaries, affiliates (collectively, the “Contest Parties”) are not eligible to enter or win.
Winners will be responsible for their own travel costs and logistics to reach the event location. The passes will be date specific and cannot be used for a later date. The prize may not be resold or offered for resale. Any transfer of the prize by a winner or his/her guest may result in the prize being declared null and void. In the event of such declaration, the Sponsor accepts no responsibility or liability, and no replacement or alternate prize will be offered or awarded.

NO PURCHASE NECESSARY. To participate in this Contest, entrants must have a valid Facebook, Instagram or Twitter account and follow or like PlayStation Canada on the social media channel(s) used to enter (i.e., Facebook, Instagram or Twitter). Entrants who do not have a Facebook, Instagram or Twitter account can visit facebook.com, instagram.com, or twitter.com (each a “Website”, collectively the “Websites”) and follow the instructions provided to register for a free account. Entrants who wish to participate using a Facebook or Instagram account must set their account to permit public viewing in order for the Sponsor to receive your Entry (as hereinafter defined).
To enter using Facebook during the Contest Period, comment on any contest post shared by the sponsor by posting a comment in the post’s comment section on Facebook at facebook.com/PlayStationCanada/ and include the hashtags #Contest and #2022Playoff within your comment. To be eligible, any comment submitted is subject to and must comply with all applicable Facebook Terms and Policies, copies of which are available at the Website.
To enter using Twitter during the Contest Period respond to any contest post shared by the sponsor on Twitter, tagging @PlayStationCA and include hashtags #Contest and #2022PlayoffTailgate.To be eligible, your entry is subject to and must comply with the Twitter Terms of Service and Twitter Rules available at the Website and conform to Twitter’s 280-character limit.
Please note that there are no correct answers.
Each entrant will receive one (1) entry (each an “Entry”, collectively “Entries”) when the entrant submits an Entry in one (1) of the formats described above and in accordance with these Official Rules and Regulations (“Rules”). Any Entry that does not follow one of the above formats as determined by Sponsor will be ineligible for entry in this Contest. Entries must not infringe, misappropriate or violate any third party’s rights, including, without limitation, copyright, trademark, right of publicity, right of privacy or trade secret and not contain any content that is offensive, illegal, obscene or that is otherwise objectionable to Sponsor, in its sole discretion. Each entrant shall indemnify the Released Parties (as hereinafter defined) against any liability for any claims and associated costs that may be brought against them by any third parties with respect to any intellectual or other property rights in the submitted Entry.
4. ENTRY SUBMISSION:
There is a limit of one (1) Entry per Facebook, Instagram or Twitter account permitted per day during the Contest Period. For greater certainty, entrants can only use one (1) Facebook account, one (1) Instagram account, and/or one (1) Twitter account to participate. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor), that any person has attempted to: (i) obtain more than one (1) Entry per Facebook, Instagram, or Twitter account per day during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities, accounts, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then said entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).
All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification): (a) for the purposes of verifying an individual’s eligibility to participate in this Contest; (b) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).
Five (5) prizes are available to be won in the Contest (each a “Prize”, collectively, “Prizes”) for each game during the contest period. The total approximate retail value (“ARV”) of each Prize is CAD $0.00. Each Prize consists of two (2) 2022 Playoff Tailgate passes for the specified date. This is for access to the outdoor tailgate viewing party only and does not grant access inside of Scotiabank Arena. This prize must be accepted as awarded and are not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitution except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute a Prize or any Prize component with a prize or component of equal or greater value without liability. Prizes will only be awarded to the individuals whose verifiable Facebook, Instagram or Twitter account, as applicable, are the sources of the selected Entries.

Prize winners are under no obligation to attend the event.
Due to the uncertainty related to the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, collectively, “COVID-19”), this Winner’s admission to the event are subject to all safety and health requirements and policies put in place by the event organizer, including any requirements relating to facemasks and/or enhanced health screenings (which may include a requirement that the Winner, and any person for whom the Winner shares admission or is in the Winner’s party, be tested for and/or vaccinated for COVID-19 prior to the Event) and the event organizer’s policies and requirements. Such policies and requirements as they may be updated from time to time (in the sole determination of the team, league and/or venue property) and as they may be communicated to the Winner prior to or during the Event (whether orally or in writing) by, for example, instruction provided by onsite personnel or signage in or around the venue, are collectively referred to below as the “Safety Requirements”. Winners will acknowledge and agree to comply with the Safety Requirements (including all requirements that must be satisfied prior to or during the Event), and acknowledge and agree that attendance at the Event is conditioned on such compliance.
Winners will agrees, on behalf of themselves and any guest they might bring to the event, that the winner and each such individual will not attend the Event if, within the prior 14 days, any such individual has tested positive for COVID-19, or, unless fully-vaccinated for COVID-19 (as defined by the Public Health Agency of Canada (“PHAC”)), any one or more of the following is true on the day of such Event:
Within the prior 14 days, any such individual was exposed to someone who has tested positive for COVID-19;
Within the prior 48 hours, any such individual has experienced symptoms of COVID-19 (e.g., a fever of 38⁰C or higher, cough, shortness of breath or difficulty breathing, chills, repeated shaking, muscle pain/achiness, headache, sore throat, new loss of taste or smell, nasal congestion, runny nose, vomiting, nausea, diarrhea, fatigue or any other symptoms associated with COVID-19 identified by the PHAC (“COVID-19 Symptoms”)); anyone who is fully vaccinated but experiences any of the COVID-19 Symptoms identified above within the 48 hours prior to the Event should nevertheless consult a healthcare provider and receive a negative test result for COVID-19 before attending;
Within the prior 14 days, any such individual has travelled to a jurisdiction identified by federal, provincial or applicable local governments as being subject to travel or quarantine advisories due to COVID-19.
The winner will expressly acknowledge an inherent risk of exposure to COVID-19 exists in any place where people gather and that no precautions (including the Safety Requirements described ABOVE) can eliminate the risk of exposure to COVID-19. COVID-19 is an extremely contagious disease that can lead to severe illness and death. While people of all ages and health conditions have been adversely affected by COVID-19, certain CATEGORIES OF people have been identified by public health authorities as having greater risk based on age and underlying medical conditions. THE WINNER VOLUNTARILY ASSUMES ALL RISK AND DANGER OF PERSONAL INJURY OR SICKNESS (INCLUDING ILLNESS AND OTHER RISKS OF EXPOSURE TO COVID-19, OR ANY OTHER COMMUNICABLE DISEASE OR ILLNESS, OR A BACTERIA, VIRUS OR OTHER PATHOGEN CAPABLE OF CAUSING A COMMUNICABLE DISEASE OR ILLNESS), LOST, STOLEN, DAMAGED OR CONFISCATED PROPERTY, AND ALL OTHER HAZARDS ARISING FROM, OR RELATED IN ANY WAY TO, THE EVENT (INCLUDING COMPLYING WITH THE SAFETY REQUIREMENTS), WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT, HOWEVER CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE.
On behalf of the winner and guests they might bring to the event, the winner will release (and covenants not to sue) each of the Released Parties (defined below) with respect to any and all claims that the winner or any person they bring to the event may have (or hereafter accrue) against any of the Released Parties and that relate in any way to (i) exposure to COVID-19; (ii) entry into, or presence within or around, the Arena or the Event (including all risks related thereto) or compliance with any protocols or Safety Requirements applicable to the Event; or (iii) any interaction between the Winner and the Winner’s guest on the one hand, and any personnel of any of the Released Parties present at the Event, on the other hand, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise.
6. WINNER SELECTION:
On each day prior to a Raptors Round 1 Playoff game (dates TBD), at the offices of the Sponsor at 9am ET (the “Selection Date”), a random drawing will be held by the Sponsor to select the potential winners from among all eligible Entries received. Odds of winning will depend upon the number of eligible Entries received.
The Sponsor or its designated representative will make a minimum of two (2) attempts to contact each selected entrant (by private message on Facebook, Instagram or Twitter, as applicable) within two (2) hours of the Selection Date/time. If the selected entrant cannot be contacted within two (2) hours of the Selection Date, or if there is a return of any notification as undeliverable; then said selected entrant may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). If the sponsor is unable to confirm with winners by 1pm ET on the event day they may, at their sole discretion, choose not to award all prizes.
BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and may be required to (b) sign and return within two (2) hours of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address (city and province of residence), voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected entrant: (a.1) fails to correctly answer the skill-testing question; (b.1) if required, fails to return the properly executed Contest documents within the specified time; (c.1) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (d.1) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).
7. GENERAL CONDITIONS:
All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, entrants agree to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
The Released Parties will not be liable for: (i) any failure of a Website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.
In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Facebook, Instagram or Twitter account submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned a Facebook account by Facebook, an Instagram account by Instagram, or a Twitter account by Twitter. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Facebook, Instagram or Twitter account, as applicable, associated with the Entry in question.
